{"data":{"id":"us-ky/krs-214.034","jurisdiction":"us-ky","citation":"KRS 214.034","heading":"Immunization of children -- Testing and treatment of children for","body":"tuberculosis -- Requirement for reception and retention of current\nimmunization certificate by schools and child-care facilities.\nExcept as otherwise provided in KRS 214.036:\n(1) All pa rents, guardians, and other persons having care, custody, or control of any\nchild shall have the child immunized against diphtheria, tetanus, poliomyelitis,\npertussis, measles, rubella, mumps, hepatitis B, and haemophilis influenzae disease\nin accordance w ith testing and immunization schedules established by regulations\nof the Cabinet for Health and Family Services. Additional immunizations may be\nrequired by the Cabinet for Health and Family Services through the promulgation of\nan administrative regulation pursuant to KRS Chapter 13A if recommended by the\nUnited States Public Health Service or the American Academy of Pediatrics. All\nparents, guardians, and other persons having care, custody, or control of any child\nshall also have any child found to be infe cted with tuberculosis examined and\ntreated according to administrative regulations of the Cabinet for Health and Family\nServices promulgated under KRS Chapter 13A. The persons shall also have booster\nimmunizations administered to the child in accordance w ith the regulations of the\nCabinet for Health and Family Services.\n(2) A local health department may, with the approval of the Department of Public\nHealth, require all first-time enrollees in a public or private school within the health\ndepartment's jurisd iction to be tested for tuberculosis prior to entering school.\nFollowing the first year of school, upon an epidemiological determination made by\nthe state or local health officer in accordance with administrative regulations\npromulgated by the Cabinet for Health and Family Services, all parents, guardians,\nand other persons having care, custody, or control of any child shall have the child\ntested for tuberculosis, and shall have any child found to be infected with\ntuberculosis examined and treated according  to administrative regulations of the\nCabinet for Health and Family Services. Nothing in this section shall be construed\nto require the testing for tuberculosis of any child whose parent or guardian is\nopposed to such testing, and who objects by a written sworn statement to the testing\nfor tuberculosis of the child on religious grounds. However, in a suspected case of\ntuberculosis, a local health department may require testing of this child.\n(3) All public or private primary or secondary schools, and presch ool programs shall\nrequire a current immunization certificate for any child enrolled as a regular\nattendee, as provided by administrative regulation of the Cabinet for Health and\nFamily Services, promulgated under KRS Chapter 13A, to be on file within two (2)\nweeks of the child's attendance.\n(4) All public or private primary schools shall require a current immunization\ncertificate for hepatitis B for any child enrolled as a regular attendee in the sixth\ngrade, as provided by administrative regulation of the  Cabinet for Health and\nFamily Services, promulgated under KRS Chapter 13A, to be on file within two (2)\nweeks of the child's attendance.\n(5) For each child cared for in a day -care center, certified family child -care home, or\nany other licensed facility wh ich cares for children, a current immunization\ncertificate, as provided by administrative regulation of the Cabinet for Health and\nFamily Services, promulgated under KRS Chapter 13A, shall be on file in the\ncenter, home, or facility within thirty (30) days  of entrance into the program or\nadmission to the facility.\n(6) Any forms relating to exemption from immunization requirements shall be available\nat public or private primary or secondary schools, preschool programs, day -care\ncenters, certified family child-care homes, or other licensed facilities which care for\nchildren.","path":["KRS Chapter 214"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=8777","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:17Z","sha256":"cab01f7405f41df678c1f341925e654f901aac30918723fef371117381f885e0","source_id":"us-ky","stale":false,"prev":"us-ky/krs-214.032","next":"us-ky/krs-214.036"},"notice":"GroundRules: Original legal text.
