{"data":{"id":"us-ky/krs-214.036","jurisdiction":"us-ky","citation":"KRS 214.036","heading":"Exceptions to testing or immunization requirement.","body":"(1) Nothing contained in KRS 158.035, 214.010, 214.020, 214.032 to 214.036, and\n214.990 shall be construed to require:\n(a) The testing for tuberculosis or the immunization of any child at a time when, in the\nwritten opinion of his or her attending health care provider, such testing or\nimmunization would be injurious to the child's health;\n(b) The immunization of any child whose parents or guardian are opposed to medical\nimmunization against disease, and who object by a written sworn statement to the\nimmunization of such child based on religious grounds; or\n(c) The immunization of any emancipated minor or adult who is opposed to medical\nimmunization against disease, and who objects by a written sworn statement to the\nimmunization based on religious grounds.\n(2) In the event of an epidemic in a given area, the Cabinet for Health and Family Services\nmay require the immunization of all persons within the area of epidemic, against the\ndisease responsible for such epidemic, except that any administrative regulation\npromulgated pursuant to KRS Chapter 13A, administrative order issued by the cabinet or\na local public health department, or executive order issued pursuant to KRS Chapter 39A\nrequiring such immunization shall not include:\n(a) The immunization of any child or adult for whom, in the written opinion of his or her\nattending health care provider, such testing or immunization would be injurious to his\nor her health;\n(b) The immunization of any child whose parents or guardians are opposed to medical\nimmunization against disease and who object by a written sworn statement to the\nimmunization based on religious grounds or conscientiously held beliefs; or\n(c) The immunization of any emancipated minor or adult who is opposed to medical\nimmunization against disease, and who objects by a written sworn statement to the\nimmunization based on religious grounds or conscientiously held beliefs.\n(3) The cabinet shall:\n(a) Develop and make available on its Web site a standardized form relating to\nexemptions in this section from the immunization requirements; and\n(b) Accept a completed standardized form when submitted.\nE ffective: September 9, 2021","path":["KRS Chapter 214"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=51860","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:17Z","sha256":"f717353e1ac8e7da5aa76ebadadb71f7aace6395c946ff48e08f46816a2175e8","source_id":"us-ky","stale":false,"prev":"us-ky/krs-214.034","next":"us-ky/krs-214.040"},"notice":"GroundRules: Original legal text.
