{"data":{"id":"us-ky/krs-214.420","jurisdiction":"us-ky","citation":"KRS 214.420","heading":"Records declared confidential -- Application.","body":"(1) The General Assembly hereby declares that confidentiality is essential for the\nproper administration and operation of sexually transmitted disease control\nactivities in this state and that the principle of confidentiality must remain inviolate.\n(2) All information, records, and reports in the possession of local health departments\nor the Cabinet for Health and Family Services and which concern persons infected\nwith or suspected of being infected with or tested for or identified in an\nepidemiologic investigation for sexually transmitted disease are hereby declared to\nbe strictly confidential and only personnel of local health departments and the\nCabinet for Health and Family Services who are assigned to sexually transmitted\ndisease control activities shall have access to such information, records, and reports.\n(3) Nothing in this section shall be construed as preventing:\n(a) The release of medical information to the physician retained by the person\ninfected with or suspected of being infected with a sexually t ransmitted\ndisease;\n(b) The release of medical or epidemiological data or information for statistical\npurposes in a manner so that no individual person can be identified;\n(c) The release of medical information with the written consent of all persons\nidentified in the information to be released;\n(d) The release of medical or epidemiological information necessary to enforce\nthe provision of the rules and regulations of the Cabinet for Health and Family\nServices, issued pursuant to KRS Chapter 13A, relating to  the control and\ntreatment of sexually transmitted disease; and\n(e) The release of medical information made to medical personnel in a medical\nemergency to the extent necessary to protect the health or life of the named\nparty.","path":["KRS Chapter 214"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=8820","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:18Z","sha256":"dd5df236468c7be1b400e8156646e1b36e4070e3c6c0c5bbb4f09cd46c23c300","source_id":"us-ky","stale":false,"prev":"us-ky/krs-214.410","next":"us-ky/krs-214.430"},"notice":"GroundRules: Original legal text.
