{"data":{"id":"us-ky/krs-214.430","jurisdiction":"us-ky","citation":"KRS 214.430","heading":"Expedited partner therapy for sexually transmitted infections.","body":"(1) For the purposes of this section, unless the context requires otherwise:\n(a) \"Dispense\" means to deliver a drug or device to an ultimate user or research\nsubject by or pursuan t to the lawful order of a practitioner, including the\npackaging, labeling, or compounding necessary to prepare the substance for\nthat delivery;\n(b) \"Expedited partner therapy\" means the prescribing or dispensing of antibiotic\ndrugs to a practitioner's dia gnosed patient's sexual partner or partners for the\nsame disease without examination of that diagnosed patient's partner or\npartners;\n(c) \"Legend drug\" means any drug defined by the Federal Food, Drug, and\nCosmetic Act, as amended, and under which definiti on its label is required to\nbear the statement, \"Caution: Federal law prohibits dispensing without\nprescription.\";\n(d) \"Practitioner\" means medical or osteopathic physicians who are licensed\nunder the professional licensing laws of Kentucky to prescribe an d administer\ndrugs and devices. \"Practitioner\" includes advanced practice registered nurses\nas authorized in KRS 314.011 and 314.042 and physician assistants when\nadministering or prescribing pharmaceutical agents as authorized in KRS\n311.858; and\n(e) \"Prescription\" means a written or oral order for a drug or medicine, or\ncombination or mixture of drugs or medicines, or proprietary preparation, that\nis signed, given, or authorized by a practitioner, and intended for use in the\ndiagnosis, cure, mitigation, treatment, or prevention of disease in humans.\n(2) Notwithstanding any other provision of law, a practitioner who is licensed to\ndiagnose and prescribe drugs for sexually transmitted infections, including but not\nlimited to trichomoniasis, gonorrhea, or chl amydia infection, who diagnoses a\nsexually transmitted infection in a patient may provide expedited partner therapy\nfor a sexually transmitted infection to that patient's sexual partner or partners.\n(3) A practitioner that provides expedited partner therapy shall:\n(a) Adhere to prescribing and dispensing standards for expedited partner therapy\npursuant to the current United States Centers for Disease Control and\nPrevention Sexually Transmitted Diseases Treatment Guidelines for expedited\npartner therapy; and\n(b) Utilize forms established by the Department for Public Health for patients and\ntheir sexual partner or partners explaining expedited partner therapy.\n(4) A practitioner who reasonably and in good faith renders expedited partner therapy\nin accordance with this section and administrative regulations promulgated by the\nboard having professional jurisdiction shall not be subject to civil or criminal\nliability or be deemed to have engaged in unprofessional conduct.","path":["KRS Chapter 214"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=54075","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:18Z","sha256":"e2548e792a75926eb3626bb09cbebbc92c5e508a93daba04b2d3919072c7c785","source_id":"us-ky","stale":false,"prev":"us-ky/krs-214.420","next":"us-ky/krs-214.450"},"notice":"GroundRules: Original legal text.
