{"data":{"id":"us-ky/krs-214.555","jurisdiction":"us-ky","citation":"KRS 214.555","heading":"Recommendation of digital mammography including breast tomosynthesis","body":"-- Notice to patient for whom mammogram demonstrates dense breast tissue --\nExpiration date of notice requirement.\n(1) Physicians are encouraged to recommend digital mammogr aphy including breast\ntomosynthesis when writing orders for mammograms. The term \"breast\ntomosynthesis\" means a radiologic procedure that involves the acquisition of\nprojection images over the stationary breast to produce cross -sectional digital three-\ndimensional images of the breast.\n(2) If a patient's X -ray mammogram demonstrates dense breast tissue, a person who\nprovided the X -ray mammography services in the Commonwealth shall provide\nnotification to the patient that includes but is not limited to the fo llowing\ninformation in the summary of the written report of the results sent directly to a\npatient:\n\"Your X -ray mammogram shows that your breast tissue is dense. Dense breast\ntissue is common among women and is not abnormal. However, women with dense\nbreast tissue may have a slightly increased risk for developing breast cancer. Dense\nbreast tissue may also make it more difficult to detect an early breast cancer on your\nX-ray mammogram. At this time, there are no specific recommendations for\nadditional scre ening or other measures related to having dense breast tissue.\nHowever, you may want to talk to your doctor about other ways that you might be\nable to reduce your risk of breast cancer. A report of your results was sent to your\nordering physician. If you a re self-referred, a report of your results was sent to you\nin addition to this summary.\"\n(3) As used in this section, \"dense breast tissue\" means heterogeneously or extremely\ndense breast tissue as defined in nationally recognized guidelines or systems for\nbreast imaging reporting of mammography screening, including but not limited to\nthe breast imaging reporting and data system established by the American College\nof Radiology. If, after June 29, 2017, new terms are defined in revised guidelines or\nsystems for breast imaging reporting of mammography screening and the\nDepartment for Public Health determines that those new terms are more appropriate\nfor the purposes of the information required to be provided under this section, the\nDepartment for Public Health may update the definition of dense breast tissue under\nthis subsection to use those new terms by administrative regulation.\n(4) Recognizing the continuous improvements in patient outcomes that are reflective of\nongoing advances in evidence -based medical p ractices, expansive and emerging\nmedical research, and evolving innovations in medical technology, subsection (2) of\nthis section shall be in effect until January 1, 2025, unless the General Assembly\ntakes action to extend this expiration date.","path":["KRS Chapter 214"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=51302","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:18Z","sha256":"cc35fd580546b75053db1b9efb1783ae19063214e6576df674764122cf8ec232","source_id":"us-ky","stale":false,"prev":"us-ky/krs-214.554","next":"us-ky/krs-214.556"},"notice":"GroundRules: Original legal text.
