{"data":{"id":"us-ky/krs-214.640","jurisdiction":"us-ky","citation":"KRS 214.640","heading":"HIV and AIDS Planning and Advisory Council -- Membership --","body":"Functions.\n(1) The Cabinet for Health and Family Services may create, to the extent permitted by\navailable staffing and funding, an HIV and AIDS Planning and Advisory Council to\nconsist of no more than thirty (30) members, for the purpose of advising the cabinet\non the formulation of HIV and AIDS policy. Membership on the committee shall be\ndrawn from the following:\n(a) The commissioner of the Department for Public Health;\n(b) The commissioner of the Department for Medicaid Services;\n(c) Representatives of other state agencies or boards that provide services to\nclients of HIV or AIDS services or that provide education to professionals\nwho come into contact with HIV or AIDS clients, as designated by the\nGovernor;\n(d) Physicians representing different geographic regions of the state;\n(e) HIV or AIDS clients; and\n(f) Representatives of community -based organizations from different geographic\nregions of the state.\nTo the extent possible, me mbership of the council shall reflect the epidemiology of\nthe HIV/AIDS epidemic.\n(2) The members designated under subsection (1)(a) to (c) of this section shall serve for\nthe duration of service in their offices, subject to removal for cause by the\nGovernor. These members shall not be paid for attending council meetings but may\nreceive reimbursement of expenses.\n(3) The members serving under subsection (1)(d) to (f) of this section shall be\nappointed by the cabinet from lists submitted by the appropriate licensing entities of\nthe profession involved, by the cabinet, and by community -based organizations.\nThese members shall serve for a term of four (4) years and may be reappointed, but\nthe members shall not serve for more than two (2) consecutive terms.\n(4) The chair of the council shall be elected from the membership serving under\nsubsection (1)(d) to (f) of this section.\n(5) The functions of the council shall include but shall not be limited to:\n(a) Reporting its findings to the cabinet and monitoring t he responsiveness of the\ncabinet to insure that the council's recommendations are being followed;\n(b) Exploring the feasibility, design, cost, and necessary funding for centers of\nexcellence to deliver comprehensive, coordinated medical and related care to\nall people with HIV or AIDS in the Commonwealth based on national clinical\nguidelines and practice standards. Coordinated medical care shall include but\nnot be limited to access to:\n1. AIDS primary care;\n2. Drug therapy;\n3. Specialists' care, including ps ychiatric and other mental health\nproviders;\n4. Case management services;\n5. Dental care;\n6. Chemical dependency treatment; and\n7. Basic needs, including but not limited to housing and food;\n(c) Assessing resources and gaps in services provided for persons  with HIV or\nAIDS;\n(d) Subdividing into necessary subcommittees. One (1) subcommittee may be\nformed that will consist solely of persons living with HIV or AIDS. This\nsubcommittee shall make those recommendations as it deems necessary to the\ncouncil, includ ing recommendations on effective peer -based prevention\nprograms; and\n(e) Reporting its findings and recommendations to the General Assembly and the\nInterim Joint Committee on Health Services by September 1, 2001, and by\nSeptember 1 of each year thereafter.","path":["KRS Chapter 214"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=53701","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:18Z","sha256":"c3db5ea0a25eca7f0d295e16bc54203d052cbb6f68a966bc1fa08e45f754e2a8","source_id":"us-ky","stale":false,"prev":"us-ky/krs-214.635","next":"us-ky/krs-214.645"},"notice":"GroundRules: Original legal text.
