{"data":{"id":"us-ky/krs-214.650","jurisdiction":"us-ky","citation":"KRS 214.650","heading":"Review of HIV and AIDS care coordination -- Surveillance of newborns","body":"exposed to HIV -- HIV and AIDS pharmacological services.\n(1) The cabinet shall:\n(a) Conduct a review of any guidelines for HIV or acquired immunodeficiency\nsyndrome (AIDS) care coordination to ensure:\n1. Consistency;\n2. Comprehensive in service; and\n3. That access to health care and sustaining individuals infected with\nHIV/AIDS in primary HIV -related medical care is the top priority for\ncare coordinators;\n(b) Conduct objective peer re views, as necessary, of each care coordination\nagency to insure that care coordinators are in compliance with the care\ncoordination guidelines;\n(c) Conduct outcome evaluations, as necessary and as permitted by funding\nlimitations, to measure the quality an d impact of the care coordinator delivery\nsystem;\n(d) Review the need for additional care coordinators to assure that client\ncaseloads are manageable and, to the extent that funds are available, strive for\na maximum client caseload of forty (40) to fifty ( 50) clients per care\ncoordinator. If, after this review, the cabinet finds the need for additional staff,\nit may develop a plan and request funding for the hiring of additional care\ncoordinators in the geographic areas of greatest need;\n(e) Review eligibil ity criteria for persons who wish to receive treatment\nmedications through the Kentucky AIDS Drug Assistance Program to ensure\nthat these funds are the funds of last resort;\n(f) Review the data collected under KRS 214.645 to determine whether allocated\nresources are sufficiently distributed to meet the geographic distribution of\nreported HIV and AIDS cases;\n(g) Work with other agencies, departments, and cabinets to advise on their\ndevelopment of educational HIV and AIDS programs that are mandated by\nlaw;\n(h) Urge access to Spanish-speaking interpreters to provide prevention, treatment,\nand service efforts where needed in the Commonwealth;\n(i) Provide for consistent and comprehensive HIV and AIDS counseling and\ntesting education in all public health departments as needed;\n(j) Require collaboration between HIV prevention educators and HIV care\ncoordinators with the goal of reducing the further tr ansmission of HIV by\nthose already infected; and\n(k) Encourage community -based organizations to develop an outreach program\ndesigned to foster active partnerships with willing faith -based communities.\nThese partnerships may be used to educate community mem bers about illegal\ndrug use, the value of harm reduction programs, and HIV and AIDS\nprevention and services.\n(2) Authorized surveillance staff designated by the cabinet shall review all known cases\nof newborns with perinatal exposure to HIV infection or with HIV infection.\n(3) Any pharmacy or clinic that provides HIV or AIDS-related medications through the\nKentucky AIDS Drug Assistance Program or any other state assistance program\nshall:\n(a) Be encouraged to provide pharmacological consultation reimbursemen t with\nwritten documentation. Documentation may include date of interview,\nassessment of timely drug refills, side effects, problems, remediation,\noutcomes noted, and the pharmacist's HIV specialized physician; and\n(b) Be encouraged to seek HIV pharmacolog ical certification in addition to\nalready recommended continuing education training on HIV and AIDS.","path":["KRS Chapter 214"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=8853","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:18Z","sha256":"17e2952a480b995f30440070606f05b537d8ec21e986a723a83e63b9094a5f76","source_id":"us-ky","stale":false,"prev":"us-ky/krs-214.645","next":"us-ky/krs-214.655"},"notice":"GroundRules: Original legal text.
