{"data":{"id":"us-ky/krs-215.560","jurisdiction":"us-ky","citation":"KRS 215.560","heading":"Affidavit of failure to comply -- Administrative and judicial action.","body":"(1) Whenever a person has reasonable cause to suspect that an individual with active\ntuberculosis has knowingly failed to comply with the provisions of KRS 215.520 to\n215.600, the person may file an affidavit with the local health department serving\nthe jurisdiction where the individual resides or where the alleged violation occurred.\nThe affiant shall state the details of the violation as completely and accurately as\npossible and the local health department shall, with the assistance of the cabinet, if\nnecessary, conduct an appropriate investigation and, if indicated, shall order the\nviolator in writing to submit to the needed precautions, including quarantine, in\norder to isolate and restrict activities, examination, or treatment. If the local health\ndepartment determines in the course of providing services that a violation has\noccurred, it may issue an order regardless of the presence of an affidavit.\n(2) If a person refuses to comply with an order of a local health department pursuant to\nsubsection (1) of thi s section, the health department shall, if the public health need\nfor intervention still exists, file a verified petition for relief with the District Court\nin the county of its principal office. The health department shall include all pertinent\ndetails in  its petition. The defendant shall have the right to be represented by\ncounsel and the case shall be handled in the same manner as a civil case in every\nother regard. If the court finds from a preponderance of the evidence or upon\nadmission by the defendan t that the defendant is in violation of provisions in KRS\n215.520 to 215.600, the court shall enter an order that the appropriate precautions,\nexaminations, or treatment be carried out.","path":["KRS Chapter 215"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=8940","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:19Z","sha256":"b19775ff93af1188fb5ad4b131219787a31dce009a41908218dc03b4dfaa52c0","source_id":"us-ky","stale":false,"prev":"us-ky/krs-215.550","next":"us-ky/krs-215.570"},"notice":"GroundRules: Original legal text.
