{"data":{"id":"us-ky/krs-216.2920","jurisdiction":"us-ky","citation":"KRS 216.2920","heading":"Definitions for KRS 216.2920 to 216.2929.","body":"As used in KRS 216.2920 to 216.2929, unless the context requires otherwise:\n(1) \"Ambulatory facility\" means an outpatient facility, including an ambulatory\nsurgical facility, freestanding or mobile technology unit, or an urgent treatment\ncenter, that is no t part of a hospital and that provides one (1) or more ambulatory\nprocedures to patients not requiring hospitalization;\n(2) \"Cabinet\" means the Cabinet for Health and Family Services;\n(3) \"Charge\" means all amounts billed by a hospital or ambulatory facili ty, including\ncharges for all ancillary and support services or procedures, prior to any adjustment\nfor bad debts, charity contractual allowances, administrative or courtesy discounts,\nor similar deductions from revenue. However, if necessary to achieve comparability\nof information between providers, charges for the professional services of hospital -\nbased or ambulatory -facility-based physicians shall be excluded from the\ncalculation of charge;\n(4) \"Facility\" means any hospital, health care service, freestan ding birthing center, or\nother health care facility, whether operated for profit or not;\n(5) \"Health care provider\" or \"provider\" means any pharmacist as defined pursuant to\nKRS Chapter 315, and any of the following independent practicing practitioners:\n(a) Physicians, osteopaths, and podiatrists licensed pursuant to KRS Chapter 311;\n(b) Chiropractors licensed pursuant to KRS Chapter 312;\n(c) Dentists licensed pursuant to KRS Chapter 313;\n(d) Optometrists licensed pursuant to KRS Chapter 320;\n(e) Physician assistants regulated pursuant to KRS Chapter 311;\n(f) Nurse practitioners licensed pursuant to KRS Chapter 314; and\n(g) Other health-care practitioners as determined by the Cabinet for Health  and\nFamily Services by administrative regulation promulgated pursuant to KRS\nChapter 13A;\n(6) \"Hospital\" means a facility licensed pursuant to KRS Chapter 216B as either an\nacute-care hospital, psychiatric hospital, rehabilitation hospital, or chemical\ndependency treatment facility;\n(7) \"Procedures\" means those surgical, medical, radiological, diagnostic, or therapeutic\nprocedures performed by a provider, as periodically determined by the cabinet in\nadministrative regulations promulgated pursuant to KRS Ch apter 13A as those for\nwhich reports to the cabinet shall be required. \"Procedures\" also includes\nprocedures that are provided in hospitals or other ambulatory facilities, or those that\nrequire the use of special equipment, including fluoroscopic equipment , computer\ntomographic scanners, magnetic resonance imagers, mammography, ultrasound\nequipment, or any other new technology as periodically determined by the cabinet;\n(8) \"Quality\" means the extent to which a provider renders care that obtains for patients\noptimal health outcomes; and\n(9) \"Secretary\" means the secretary of the Cabinet for Health and Family Services.","path":["KRS Chapter 216"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=56430","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:20Z","sha256":"e86906ae25841a8c07627dfe479cd07076126c201556b8644ba37d329c8937f7","source_id":"us-ky","stale":false,"prev":"us-ky/krs-216.2907","next":"us-ky/krs-216.2921"},"notice":"GroundRules: Original legal text.
