{"data":{"id":"us-ky/krs-216.2923","jurisdiction":"us-ky","citation":"KRS 216.2923","heading":"Health data collection powers and duties -- Analysis of health -care and","body":"insurance experience -- Administrative regulations.\n(1) For the purposes of carrying out the provisions of KRS 216.2920 to 216.2929, the\nsecretary may:\n(a) Appoint tem porary volunteer advisory committees, which may include\nindividuals and representatives of interested public or private entities or\norganizations;\n(b) Apply for and accept any funds, property, or services from any person or\ngovernment agency;\n(c) Make agreements with a grantor of funds or services, including an agreement\nto make any study allowed or required under KRS 216.2920 to 216.2929; and\n(d) Contract with a qualified, independent third party for any service necessary to\ncarry out the provisions of KRS  216.2920 to 216.2929; however, unless\npermission is granted specifically by the secretary a third party hired by the\nsecretary shall not release, publish, or otherwise use any information to which\nthe third party has access under its contract.\n(2) For the purposes of carrying out the provisions of KRS 216.2920 to 216.2929, the\nsecretary shall:\n(a) Periodically participate in or conduct analyses and studies that relate to:\n1. Health-care costs;\n2. Health-care quality and outcomes;\n3. Health care providers and health services; and\n4. Health insurance costs;\n(b) Promulgate administrative regulations pursuant to KRS Chapter 13A that\nrelate to its meetings, minutes, and transactions related to KRS 216.2 920 to\n216.2929; and\n(c) Prepare annually a budget proposal that includes the estimated income and\nproposed expenditures for the administration and operation of KRS 216.2920\nto 216.2929.\n(3) The cabinet may promulgate administrative regulations pursuant to  KRS Chapter\n13A that impose civil fines not to exceed five hundred dollars ($500) for each\nviolation for knowingly failing to file a report as required under KRS 216.2920 to\n216.2929.
