{"data":{"id":"us-ky/krs-216.2980","jurisdiction":"us-ky","citation":"KRS 216.2980","heading":"Hospice, palliative care, and end-of-life services providers to have policies","body":"and procedures for deactivation or sequestration and disposal of controlled\nsubstances upon death of patient or discontinuance of prescription -- Notice --\nWritten agreement -- Witness statement.\n(1) Any provider of hospice, palliative care, or end -of-life services shall have written\npolicies and procedures for the deactivation or sequestration and disposal of\nSchedule II, III, IV, or V controlled substances prescri bed to a patient when a\nprescription is discontinued or upon the patient's death by the entity or person\npronouncing the death.\n(2) Any provider of hospice, palliative care, or end -of-life services shall provide a copy\nof the written policy and procedures for the management and the deactivation or\nsequestration and disposal of Schedule II, III, IV, or V controlled substances\nprescribed to a patient when a prescription is discontinued or upon the patient's\ndeath, to the patient or the patient's legal represe ntative, and the provider shall\ndiscuss the policy and procedures with the patient or the patient's legal\nrepresentative. The patient or the patient's legal representative shall be requested to\nsign an agreement to this policy.\n(3) In an effort to reduce i llegal diversion of Schedule II, III, IV, or V controlled\nsubstances, the agreement to the written policy and procedures required under\nsubsection (2) of this section shall inform the patient or the patient's legal\nrepresentative that if the patient or the  patient's legal representative refuses to agree\nto the deactivation or sequestration and disposal when a prescription is discontinued\nor upon the death of the patient, local law enforcement shall be notified of the\nrefusal by the hospice, palliative care,  or end-of-life services provider or the entity\nor person pronouncing death.\n(4) The deactivation or sequestration and disposal of Schedule II, III, IV, or V\ncontrolled substances prescribed to a patient when a prescription is discontinued or\nupon the pati ent's death shall be completed by the entity or person pronouncing\ndeath and witnessed by an adult. The witness shall sign a statement that he or she\nwitnessed the deactivation or sequestration and disposal.\n(5) The deactivation or sequestration and dispos al methods of Schedule II, III, IV, or V\ncontrolled substances used by the entity or person pronouncing death shall comply\nwith the United States Food and Drug Administration's recommendations for the\nsafe disposal of unused medicines or shall be another s afe deactivation or\nsequestration and disposal method.","path":["KRS Chapter 216"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=50041","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:20Z","sha256":"7b0ea05cc4fb4880a1d5a0f4839bca0f415168a08b90480b2f82fda476981d82","source_id":"us-ky","stale":false,"prev":"us-ky/krs-216.2975","next":"us-ky/krs-216.300"},"notice":"GroundRules: Original legal text.
