{"data":{"id":"us-ky/krs-216.335","jurisdiction":"us-ky","citation":"KRS 216.335","heading":"Powers of board.","body":"The government of the hospital district shall be vested in the board which shall have\ngeneral control of the property and affairs of the district and shall have all the powers\nnecessary to carry out the purposes of KRS 216.310 to 216.360 including, but not\nconfined to, the following:\n(1) To construct, acquire, add to, maintain, operate, develop and regulate, sell and\nconvey all lands, property rights, equipment, hospital facilities and systems for the\nmaintenance of hospitals, buildings, structures and any other facilities;\n(2) To exercise the right of eminent domain for the purposes of the district except that\nno hospital district shall have the right of eminent domain against any hospital,\nclinic or sanatorium operated by a nonprofit charitable, religious or public\norganization, or against any private hospital, clinic or sanatorium;\n(3) To receive, acquire, hold, manage, expend, sell and convey donations and bequests\nof real and personal property for hospital purposes within the district;\n(4) To establish a nd maintain a public hospital or hospitals in the district and where\nnecessary make provision for education of needed personnel to operate such\nhospitals;\n(5) To lease existing hospital or hospitals and equipment and other property used in\nconnection with the operation of a hospital, and to pay such rental therefor as the\nboard shall deem proper;\n(6) To enter into contracts and agreements with any person or corporation, public or\nprivate, affecting the affairs of the district, including contracts with citie s, counties,\nother municipalities, the Commonwealth or the United States of America and any of\nits agents or instrumentalities;\n(7) To enter into contracts with a nonprofit corporation acting as a governmental\nagency for the construction and equipping of a  hospital or hospitals, and the leasing\nof the same to the district;\n(8) To sue and be sued;\n(9) To make contracts, employ an administrator, attorneys and other technical or\nprofessional assistance and all other employees as the needs of the district may\nrequire, and to prescribe their duties and compensation;\n(10) To have perpetual existence;\n(11) To borrow money on the credit of the board in anticipation of the revenue to be\nderived from anticipated revenue from user fees or from taxes levied by the distr ict\nfor the fiscal year in which the money is borrowed, and to pledge the taxes levied\nfor the district for the payment of the principal and interest of the loan;\n(12) To establish bylaws it deems necessary or expedient to define the duties of officers,\nassistants or employees, to fix the conditions of admission to the hospitals of the\ndistrict, and the support and discharge of patients, and to conduct in a proper\nmanner the professional and business affairs of the district;\n(13) To establish and enforce a suitable system of rules and regulations for the internal\ngovernment, discipline and management of the hospitals of the district;\n(14) To determine annually the amount of tax, not to exceed ten cents ($0.10) per one\nhundred dollars ($10 0) of property assessed for taxation, to be levied upon the\ntaxable property of the district, for the purposes of the district, and to certify to the\nfiscal court of each county in the district and to each county clerk for inclusion on\nthe tax bills of property owners in the district.","path":["KRS Chapter 216"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=9020","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:20Z","sha256":"978dcdab271237d96c18ffa972007b6039609739bee8678d2d08e7bddf5ad30f","source_id":"us-ky","stale":false,"prev":"us-ky/krs-216.333","next":"us-ky/krs-216.336"},"notice":"GroundRules: Original legal text.
