{"data":{"id":"us-ky/krs-216.357","jurisdiction":"us-ky","citation":"KRS 216.357","heading":"Dissolution of district, procedure.","body":"A hospital district may be dissolved in the following manner:\n(1) Upon determining that the district should be dissolved, the board shall unanimously\nadopt a resolution calling for the dissolution of the district. This resolution shall be\nsent to the fiscal court of each participating county for their action.\n(2) Upon receipt of the resolution for dissolution each fiscal court shall take action. If\nthe fiscal court of each participating county determines that the district shall be\ndissolved, they shall adop t a resolution of intent to dissolve the district within six\n(6) months of the receipt of such a resolution from the board.\n(3) A certified copy of the order of the fiscal court along with a plan for the settlement\nof all outstanding obligations and debts of the district shall be filed with the\nsecretary and with the county clerk.\n(4) Upon receipt of the resolution of intent to dissolve the district and the settlement\nplan from the fiscal court of each county in the district, the secretary may issue a\ncertificate of dissolution. This certificate shall be filed with the Secretary of State,\nthe state local finance officer and the county clerk of each county in the district.\n(5) The county clerk or clerks in the district, shall, upon receipt of the certificate of\ndissolution from the secretary, remove the tax levy from the tax bills from the\nproperty owners of the district and the district shall be dissolved.\n(6) A resolution of dissolution shall not be entered within a one (1) year period from\nthe date of the e ntry of the order declaring the district organized, or one (1) year\nfrom the date of final determination of any action to set aside such an order,\nwhichever is later.","path":["KRS Chapter 216"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=9030","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:21Z","sha256":"30f38f32235cad86bd663d83a6d453a9fde99a72e7c0b4bfd06a9099606af4de","source_id":"us-ky","stale":false,"prev":"us-ky/krs-216.355","next":"us-ky/krs-216.360"},"notice":"GroundRules: Original legal text.
