{"data":{"id":"us-ky/krs-216.533","jurisdiction":"us-ky","citation":"KRS 216.533","heading":"Department for Behavioral Health, Developmental and Intellectual","body":"Disabilities long -term care facilities -- Criminal background checks for\napplicants for employment -- Persons who may not be employed -- Effect of\npardon or expunged record -- Exemption from KRS 216.789(1).\n(1) A long -term care facility owned, managed, or operated by the Department for\nBehavioral Health, Developmental and Intellectual Disabilities shall request an in -\nstate criminal background information check from the Justice and Publi c Safety\nCabinet or Administrative Office of the Courts for each applicant recommended for\nemployment. Out -of-state criminal background information checks shall be\nobtained for any applicant recommended for employment who has resided or been\nemployed outside of the Commonwealth.\n(2) No facility specified in subsection (1) of this section shall knowingly employ any\nperson who has been convicted of a felony offense under:\n(a) KRS Chapter 209;\n(b) KRS Chapter 218A;\n(c) KRS 507.020, 507.030, and 507.040;\n(d) KRS Chapter 509;\n(e) KRS Chapter 510;\n(f) KRS Chapter 511;\n(g) KRS Chapter 513;\n(h) KRS 514.030;\n(i) KRS Chapter 530;\n(j) KRS Chapter 531;\n(k) KRS 508.010, 508.020, 508.030, and 508.032;\n(l) A criminal statute of the United States or another state similar to  paragraphs\n(a) to (k) of this subsection; or\n(m) A violation of the uniform code of military justice or military regulation\nsimilar to paragraphs (a) to (k) of this subsection which has caused the person\nto be discharged from the Armed Forces of the United States.\n(3) A person who has received a pardon for an offense specified in subsection (2) or has\nhad the record of such an offense expunged may be employed.\n(4) Department for Behavioral Health, Developmental and Intellectual Disabili ties\nfacilities specified in subsection (1) of this section shall be exempt from the\nprovisions of KRS 216.789(1).","path":["KRS Chapter 216"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=40830","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:21Z","sha256":"ee4ca122d73ae80a8da83565faa4d935e6ead77c96bae1127329f7ecf8b3afb2","source_id":"us-ky","stale":false,"prev":"us-ky/krs-216.532","next":"us-ky/krs-216.535"},"notice":"GroundRules: Original legal text.
