{"data":{"id":"us-ky/krs-216.541","jurisdiction":"us-ky","citation":"KRS 216.541","heading":"Willful interference with representatives of Office of the Long -Term-Care","body":"Ombudsman prohibited -- Retaliation against complainant prohibited --\nPenalty -- Liability insurance for representatives of the ombudsman program.\n(1) Willful interference, as d efined in KRS 216.535, with representatives of the Office\nof the Long-Term-Care Ombudsman in the lawful performance of official duties, as\nset forth in the Older Americans Act, 42 U.S.C. secs. 3001 et seq., shall be\nunlawful.\n(2) Retaliation and reprisals by a long -term-care facility or other entity against any\nemployee or resident for having filed a complaint or having provided information to\nthe long-term care ombudsman shall be unlawful.\n(3) A violation of subsection (1) or (2) of this section shall resu lt in a fine of one\nhundred dollars ($100) to five hundred dollars ($500) for each violation. Each day\nthe violation continues shall constitute a separate violation. The manner in which\nappeals are presented for violations of this section shall be in accor dance with\nadministrative regulations prescribed by the secretary for determining the rights of\nthe parties. All fines collected pursuant to this section shall be used for programs\nadministered by the Department for Aging and Independent Living.\n(4) The Ca binet for Health and Family Services shall authorize the acquisition of\nliability insurance for the protection of representatives of the Long -Term-Care\nOmbudsman Program who are not employed by the state, to ensure compliance with\nthe federal mandate that no representative of the office shall be liable under state\nlaw for the good faith performance of official duties.","path":["KRS Chapter 216"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=9070","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:21Z","sha256":"910c717fa579319d566e26228ef0801e19f2e97f95773dc9b62188af13d5e013","source_id":"us-ky","stale":false,"prev":"us-ky/krs-216.540","next":"us-ky/krs-216.543"},"notice":"GroundRules: Original legal text.
