{"data":{"id":"us-ky/krs-216.555","jurisdiction":"us-ky","citation":"KRS 216.555","heading":"Long-term  care facility -- Citation by cabinet for violations of","body":"regulations, standards, and requirements -- Restriction on publication of\nresults of survey, inspection, or investigation.\n(1) If upon inspection or investigation the cabinet determines that a long-term care\nfacility has violated the regulations, standards, and requirements as set forth by\nthe cabinet pursuant to the provisions of KRS  216.510 to 216.525, or\napplicable federal laws and  regulations governing the certification of a\nlong-term care facility under Title 18 or 19 of the Social Security Act and such\nviolation has been classified in KRS  216.557, the cabinet shall immediately\nissue a citation to the licensee of the long-term care facility. Each notice of\nviolation shall be prepared in writing and shall specify the nature of the\nviolation, and the statutory provision or regulation alleged to have been\nviolated.\n(2) Except  as otherwise provided in this section, the results of a survey,\ninspection, or investigation of a long-term care facility conducted by any state\nor federal department or agency, including all statements of deficiencies,\nfindings of deficiency, and all plans of correction, shall not be used in an\nadvertisement publication, unless the advertisement publication includes all of\nthe following:\n(a) The date the survey, inspection, or investigation was conducted;\n(b) A  statement that a facility is required to submit a plan of correction in\nresponse to a statement of deficiencies, if applicable;\n(c) If a finding or deficiency cited in the statement of deficiencies has been\ncorrected, a statement that the finding or deficiency has been corrected\nand the date that the finding or deficiency was corrected; and\n(d) A  statement that the advertisement publication is not authorized or\nendorsed  by the Cabinet for Health and Family Services, Office of\nInspector General, the Centers for Medicare and Medicaid Services, or\nany other government agency.\n(3) This  section does  not prohibit the results of a  survey, inspection, or\ninvestigation conducted under this section from being used in an administrative\nproceeding or a civil or criminal investigation or prosecution.\n(4) The information required by subsection (2) of this section shall:\n(a) Be  in the same color, font, and size as the other language on or in the\nadvertisement publication; and\n(b) Appear  as prominent as other language used in the advertisement\npublication.","path":["KRS Chapter 216"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=46506","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:21Z","sha256":"1c480b07fcbdb586d4a9433f9ff780050028f6219be280758965d77b3a3c6a66","source_id":"us-ky","stale":false,"prev":"us-ky/krs-216.553","next":"us-ky/krs-216.557"},"notice":"GroundRules: Original legal text.
