{"data":{"id":"us-ky/krs-216.577","jurisdiction":"us-ky","citation":"KRS 216.577","heading":"Action of secretary against facility for failure to correct a Type A violation.","body":"(1) Upon a finding that conditions in a long -term care facility constitute a Type A\nviolation, and the licensee fails to correct the violation within the time s pecified for\ncorrection by the cabinet, the secretary shall take at least one (1) of the following\nactions with respect to the facility in addition to the issuance of a citation, or the\nassessment of a civil penalty therefor:\n(a) Institute proceedings to o btain an order compelling compliance with the\nregulations, standards, or requirements as set forth by the Cabinet for Health\nand Family Services, the provisions of KRS 216.510 to 216.525, or applicable\nfederal laws and regulations governing the certificati on of a long -term care\nfacility under Title 18 or 19 of the Social Security Act;\n(b) Institute injunctive proceedings in Circuit Court to terminate the operation of\nthe facility; or\n(c) Selectively transfer residents whose care needs are not being adequate ly met\nby the long-term care facility.\n(2) This section shall not apply to assisted living communities licensed under KRS\n194A.700 to 194A.729.","path":["KRS Chapter 216"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=52536","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:21Z","sha256":"5795236876e5f8126970136085bac27cf70dc71e3d1244bc0d9ec00885812e52","source_id":"us-ky","stale":false,"prev":"us-ky/krs-216.575","next":"us-ky/krs-216.580"},"notice":"GroundRules: Original legal text.
