{"data":{"id":"us-ky/krs-216.590","jurisdiction":"us-ky","citation":"KRS 216.590","heading":"Definitions -- Training of surveyors and investigators -- Joint training with","body":"staff of long-term care facilities.\n(1) As used in this section:\n(a) \"CMS\" means the Centers for Medicare and Medicaid Services;\n(b) \"Long-term care facility\" means  a nursing facility that is certified under Title\nXVIII or XIX of the Social Security Act; and\n(c) \"Long-term care provider association\" includes but is not limited to the\nKentucky Association of Health Care Facilities, the Kentucky Center for\nAssisted Living, and LeadingAge Kentucky.\n(2) The cabinet shall provide training for surveyors and investigators who perform\nduties related to KRS 216.537 to 216.590.\n(3) The Cabinet for Health and Family Services and representatives of long -term care\nprovider associations shall evaluate and discuss opportunities for joint training no\nless than annually or upon the release of any new regulatory guideline, regulation,\ninterpretation, program letter, or memorandum, or, if permitted by CMS, any other\nnew materials used in surveyor training.\n(4) The cabinet shall invite representatives of long -term care provider associations to\nparticipate in the planning process for any joint surveyor and provider training\nsession, which may be held in person or remotely.\n(5) (a) The cabin et may seek approval from CMS to utilize money from the Civil\nMoney Penalty Reinvestment Program to cover the costs of joint training for\nsurveyors and staff of long-term care facilities.\n(b) If CMS denies the cabinet's application for funding to cover the cost of an in -\nperson training session, the cabinet shall charge the long -term care provider\nassociations for providing the training.\n(6) If the training is approved by the cabinet, nothing in  this section shall prohibit a\nlong-term care provider association from offering joint training to its membership\nand surveyors.","path":["KRS Chapter 216"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=53775","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:21Z","sha256":"0396f35f6e10941345342fb9e3089ce6aae492bab4cfdb1614e367b96d8f41b4","source_id":"us-ky","stale":false,"prev":"us-ky/krs-216.587","next":"us-ky/krs-216.593"},"notice":"GroundRules: Original legal text.
