{"data":{"id":"us-ky/krs-216.595","jurisdiction":"us-ky","citation":"KRS 216.595","heading":"Requirements for assisted living communities and long -term care facilities","body":"claiming to provide special care for persons with Alzheimer's disease or other\nbrain disorders -- Waiver on building requirements to address specific needs.\n(1) (a) Any assisted living community as defined by KRS 194A.700 or long -term\ncare facility as defined in KRS 216.535 that claims to provide special care for\npersons with a medical diagnosis of Alzheimer's disease or other brain\ndisorders shall maintain a writte n and current manual that contains the\ninformation specified in subsection (2) of this section. This manual shall be\nmaintained in the office of the community's or facility's director and shall be\nmade available for inspection upon request of any person. T he community or\nfacility shall make a copy of any program or service information contained in\nthe manual for a person who requests information about programs or services,\nat no cost to the person making the request.\n(b) Any advertisement of the community o r facility shall contain the following\nstatement: \"Written information relating to this community's or facility's\nservices and policies is available upon request.\"\n(c) The community or facility shall post a statement in its entrance or lobby as\nfollows: \"W ritten information relating to this community's or facility's\nservices and policies is available upon request.\"\n(2) The community or facility shall maintain and update written information on the\nfollowing:\n(a) The assisted living community's or long -term c are facility's mission or\nphilosophy statement concerning the needs of residents with Alzheimer's\ndisease or other brain disorders;\n(b) The process and criteria the assisted living community or long -term care\nfacility uses to determine placement into services for persons with Alzheimer's\ndisease or other brain disorders;\n(c) The process and criteria the assisted living community or long -term care\nfacility uses to transfer or discharge persons from special services for\nAlzheimer's or other brain disorders;\n(d) The supervision provided for residents with a medical diagnosis of\nAlzheimer's disease or other brain disorders;\n(e) The family's role in care;\n(f) The process for assessing, planning, implementing, and evaluating the plan of\ncare for persons with Alzheimer's disease or other brain disorders;\n(g) A description of any special care services for persons with Alzheimer's disease\nor other brain disorders;\n(h) Any costs associated with specialized services for Alzheimer's disease or other\nbrain disorders; and\n(i) A description of dementia or other brain disorder -specific staff training that is\nprovided, including but not limited to the content of the training, the number\nof offered and required hours of training, the schedule for training, and the\nstaff who are required to complete the training.\n(3) An assisted living community may request a waiver from the Cabinet for Health and\nFamily Services regarding building requirements to address the specialized needs of\nindividuals with Alzheimer's disease or other brain disorders.","path":["KRS Chapter 216"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=52537","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:21Z","sha256":"089113ff32e72e41e55e7250a1cdf992dda553a76841d337c445d654e73bb12a","source_id":"us-ky","stale":false,"prev":"us-ky/krs-216.593","next":"us-ky/krs-216.597"},"notice":"GroundRules: Original legal text.
