{"data":{"id":"us-ky/krs-216.705","jurisdiction":"us-ky","citation":"KRS 216.705","heading":"Health facilities to develop and execute workplace safety assessment --","body":"Requirements.\n(1) (a) Health facilities shall develop and execute a workplace safety assessment to\nidentify the risk of workplace violence against health care workers.\n(b) Health facilities shall create a workplace safety plan to address the risks\nidentified in the workplace safety assessment. Each health facility shall\ndevelop the workplace safety plan in a way that affords appropriate\nrepresentation from all the differen t types of health care workers operating on\nthe premises.\n(2) The workplace safety assessment described in subsection (1)(a) of this section shall\noutline strategies aimed at addressing security considerations and factors that may\ncontribute to or present the risk of workplace violence, including but not limited to\nthe following:\n(a) The physical attributes of the health facility setting, including security\nsystems, alarms, emergency response, and security personnel available;\n(b) Staffing, including staffing patterns, patient classifications, and procedures to\nmitigate violence against health care workers;\n(c) Job design, equipment, and facilities;\n(d) First aid and emergency procedures;\n(e) The reporting of violent acts;\n(f) Health care worker education and training requirements and implementation\nstrategy;\n(g) Security risks associated with specific units, areas of the health facility with\nuncontrolled access, late night or early morning shifts, and health care worker\nsecurity in areas surrounding the health facility such as the parking areas; and\n(h) Intervention procedures for providing assistance to a health care worker\ndirectly affected by an incident of workplace violence.\n(3) Health facilities shall annually:\n(a) Conduct a workplace safety assessment;\n(b) Review the workplace violence incidents from the previous year for patterns\nthat indicate risk; and\n(c) Review the workplace safety plan and make any necessary adjustments.\n(4) In developing the workplace safety assessme nt and safety plan required by\nsubsections (1) to (3) of this section, the health facility shall consider any guidelines\non workplace safety standards issued by the cabinet pursuant to KRS 216.703.","path":["KRS Chapter 216"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=53960","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:22Z","sha256":"a2b0abad486431512b08e153edb268600a47e7e6d18e74953524873aab6300a5","source_id":"us-ky","stale":false,"prev":"us-ky/krs-216.703","next":"us-ky/krs-216.707"},"notice":"GroundRules: Original legal text.
