{"data":{"id":"us-ky/krs-216.709","jurisdiction":"us-ky","citation":"KRS 216.709","heading":"Reporting system for acts of workplace violence -- Recordkeeping --","body":"Procedures to follow up with and support victims of workplace violence.\n(1) Health facilities shall develop an internal reporting system for acts of workplace\nviolence commit ted against a health care worker, patient, or visitor on the health\nfacility's premises, and shall train health care workers on the proper reporting\nprocedure.\n(2) Health facilities shall maintain a record of reported acts of workplace violence\ncommitted a gainst a health care worker, patient, or visitor on the health facility's\npremises. Each record shall be kept for five (5) years following the date the act was\nreported, during which time the record shall be available for inspection by the\ncabinet upon request. The report shall include:\n(a) The health facility's name and address;\n(b) The date, time, and specific location on the health facility's premises where\nthe reported workplace violence occurred;\n(c) The name, job title, department or ward assignment, and staff identification or\nSocial Security number of the victim;\n(d) A description of the person against whom the act was committed as:\n1. A patient;\n2. A visitor;\n3. A health care worker; or\n4. Other;\n(e) A description of the person who allegedly committed the violent act as:\n1. A patient;\n2. A visitor;\n3. An employee; or\n4. Other;\n(f) A description of the type of workplace violence committed as:\n1. Harassment, verbal abuse, or other threatening and violent behavior with\nno physical contact or violence;\n2. Physical violence resulting in mild soreness, surface abrasions,\nscratches, or small bruises;\n3. Physical violence resulting in major soreness, cuts, or large bruises;\n4. Physical violence resulting in sev ere lacerations, a bone fracture, or a\nhead injury; or\n5. Physical violence resulting in loss of limb or death;\n(g) An identification of any body part injured;\n(h) A description of any weapon used;\n(i) The number of health care workers in the vicinity of t he act when it occurred;\nand\n(j) A description of actions taken by employees of the health facility in response\nto the act.\n(3) Health facilities shall develop a procedure to follow up with victims of the reported\nacts of workplace violence.\n(4) Health fac ilities shall provide victims of workplace violence with support which\nmay include access to physical and mental health resources.","path":["KRS Chapter 216"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=53962","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:22Z","sha256":"99ae61e8db4d4f38f7f513a41664cf76191a3ecd902672f42fa0e870704b2140","source_id":"us-ky","stale":false,"prev":"us-ky/krs-216.707","next":"us-ky/krs-216.710"},"notice":"GroundRules: Original legal text.
