{"data":{"id":"us-ky/krs-216.710","jurisdiction":"us-ky","citation":"KRS 216.710","heading":"Definitions for KRS 216.710 to 216.714.","body":"As used in KRS 216.710 to 216.714:\n(1) \"Cabinet\" means the Cabinet for Health and Family Services;\n(2) \"Client\" means an individual who has been accepted to receive personal services\nfrom a personal services agency;\n(3) \"Crime\" means a conviction of or ple a of guilty to a felony offense related to theft;\nabuse or sale of illegal drugs; abuse, neglect, or exploitation of an adult or child; or\nthe commission of a sex crime. Conviction of or a plea of guilty to an offense\ncommitted outside the Commonwealth of Kentucky is a crime if the offense would\nhave been a felony if committed in Kentucky;\n(4) \"Department\" means a department designated by the Cabinet for Health and Family\nServices;\n(5) \"Designated representative\" means a person who has legal authority or is designated\nby the client to act on behalf of the client with regard to the action to be taken;\n(6) \"Direct-care staff member\" means a home health aide or a personal service aide\nwhose work involves extensive contact with residents or program participants who\nexhibit symptoms of Alzheimer's disease or other dementias;\n(7) \"Direct service\" means personal or group interaction between the employee and the\nclient;\n(8) \"Facilities or programs\" means residential facilities or home -and-community-based\nservice programs and includes but is not limited to personal service agencies and\nhome health agencies that have residents or program participants who exhibit\nsymptoms of Alzheimer's disease or other dementias;\n(9) (a) \"Personal services\" means:\n1. Assisting with a cl ient's ambulation and activities of daily living as\ndefined in KRS 194A.700;\n2. Facilitating the self -administration of medicatio ns if such medications\nare prepared or directed by a licensed health -care professional or the\nclient's designated representative;\n3. Providing services which may be referred to as attendant care, in -home\ncompanion, sitter and respite care services, and hom emaker services\nwhen provided in conjunction with other personal services; and\n4. Providing services that enable the client to live safely, comfortably, and\nindependently;\n(b) \"Personal services\" excludes the following:\n1. Housing and services provided by a health facility or service as defined\nin KRS 216B.015;\n2. Voluntary services provided by employers or membership organizations\nfor their employees, members, and families of the employees or\nmembers if the services are not the predominant purpose of the employer\nor the membership organization's business;\n3. House cleaning, laundry, personal shopping, or transportation provided\nby an entity if the entity offers no other personal services;\n4. Services provided by the client's family or by individuals who pro vide\nservices to no more than three (3) clients concurrently;\n5. Individuals or entities that provide all personal services on a voluntary\nbasis;\n6. Services that require the order of a licensed health -care professional to\nbe lawfully performed in Kentucky;\n7. Hospitals or other entities that provide information to consumers\nregarding persons who are available as caregivers if the hospital or other\nentity makes no attempt to manage or coordinate the selection of such\npersons for consumers and a disclaimer i s provided that the entity\nproviding the information has not made an independent assessment of\nthe ability of the individual or agency to provide personal services;\n8. Free Internet resources that identify potential caregivers; and\n9. Any health -care entit y or health -care practitioner otherwise licensed,\ncertified, or regulated by local, state, or federal statutes or regulations;\n(10) \"Personal services agency\" means any person, business entity, corporation, or\nassociation, either for -profit or not -for-profit, that directly provides or makes\nprovision for personal services through:\n(a) Its own employees or agents;\n(b) Contractual arrangements with independent contractors; or\n(c) Referral of persons to render personal services if the person making the\nreferral has an ownership or financial interest that is realized from the delivery\nof those services;\n(11) \"Parent personal services agency\" means a personal services agency located in\nKentucky that develops and maintains administrative and fiscal control over a\nbranch office in a different Kentucky location, and does not include an out -of-state\npersonal services agency with a branch office in Kentucky;\n(12) \"Recipient\" means an individual receiving nonmedical home health services or\nmedical home-health services; and\n(13) \"Secretary\" means the secretary of the Cabinet for Health and Family Services.","path":["KRS Chapter 216"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=51059","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:22Z","sha256":"8d07974f561a8ab2c56872b48f0fefe84f215ed69f6d18b1213b148c3b69556b","source_id":"us-ky","stale":false,"prev":"us-ky/krs-216.709","next":"us-ky/krs-216.712"},"notice":"GroundRules: Original legal text.
