{"data":{"id":"us-ky/krs-216.718","jurisdiction":"us-ky","citation":"KRS 216.718","heading":"Definitions for KRS 216.718 to 216.728.","body":"As used in KRS 216.718 to 216.728:\n(1) \"Assisted living community\" has the same meaning as in KRS 194A.700;\n(2) \"Cabinet\" means the Cabinet for Health and Family Services;\n(3) \"Controlling person\" means:\n(a) A corporation, partnership, or other business entity, or an officer, program\nadministrator or director thereof, whose responsibilities include the direction\nof the management or policies of a health care services agency; or\n(b) An individual who, directly or indirectly, beneficially owns an interest in a\ncorporation, partnership, or other bu siness entity that is a health care services\nagency;\n(4) \"Direct care service\" means a service provided to a resident in an assisted living\ncommunity, a resident in a long -term care facility, or a patient in a hospital, by\ndirect care staff;\n(5) \"Health care services agency\" means any person, firm, corporation, partnership, or\nother business entity engaged in the business of referring temporary direct care staff\nto render temporary direct care services to an assisted living community, a long -\nterm care facil ity, or a hospital but does not include a health care services agency\noperated by an assisted living community, a long -term care facility, a hospital, or\nany affiliates thereof, solely for the purpose of procuring, furnishing, or referring\ntemporary direct care staff for employment at that assisted living community, long -\nterm care facility, hospital, or any affiliates thereof;\n(6) \"Hospital\" means a facility licensed pursuant to KRS Chapter 216B as an acute-care\nhospital, psychiatric hospital, rehabilitatio n hospital, or chemical dependency\ntreatment facility;\n(7) \"Long-term care facilities\" has the same meaning as in KRS 216.510;\n(8) \"Permanent direct care staff\" means an individual who contracts with or is\nemployed by a health care services agency on a nontemporary basis to provide\ndirect care services to residents in assisted living communities, residents in long -\nterm care facilities, or patients in hospitals; and\n(9) \"Temporary direct care staff\" means an individual who contracts with or is\nemployed by a health care services agency for an undefined duration or a duration\nof less than twenty -four (24) continuous months exclusive of an y extension to\nprovide direct care services to residents in assisted living communities, residents in\nlong-term care facilities, or patients in hospitals.","path":["KRS Chapter 216"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=53776","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:22Z","sha256":"a539078b500622144fc0541b0f60a25c100c3b65833e26ac20d3bcba3105c5b5","source_id":"us-ky","stale":false,"prev":"us-ky/krs-216.716","next":"us-ky/krs-216.720"},"notice":"GroundRules: Original legal text.
