{"data":{"id":"us-ky/krs-216.720","jurisdiction":"us-ky","citation":"KRS 216.720","heading":"Registration of health care services agency required -- Application --","body":"Administrative regulations -- Fees -- Administrative hearing.\n(1) No health care services agency shall be operated, maintained, or advertised without\nregistering with the Cabinet for Health and Family Services. Each separate location\nof a health care services agency shall register and obtain a separate registration.\n(2) The cabinet shall promulgate administrative regulations in accordance with KRS\nChapter 13A to establish t he application process for health care services agency\nregistration. The application shall include:\n(a) The names and addresses of any controlling person;\n(b) The names and addresses of any owner who does not meet the definition of\ncontrolling person. If t he owner is a corporation, the application shall include\ncopies of its articles of incorporation and current bylaws, and the names and\naddresses of its officers and directors;\n(c) Satisfactory proof of compliance with KRS 216.718 to 216.728;\n(d) A policy a nd procedure that describes how the health care services agency's\nrecords will be immediately available to the cabinet upon request;\n(e) Any other relevant information that the cabinet determines is necessary to\nproperly evaluate an application for registration; and\n(f) A registration fee in the amount of three thousand dollars ($3,000) per\nregistration.\n(3) The cabinet shall deny any application for health care services agency registration\nfor failure to provide the information required by this section.\n(4) A registration issued by the cabinet to a health care services agency shall be\neffective for a period of one (1) year from the date of its issuance unless the\nregistration is revoked for noncompliance with KRS 216.718 to 216.728. If a\ncontrolling person changes, the health care services agency is sold, or management\nis transferred, the registration of the agency shall be voided and the new controlling\nperson, owner, or manager may apply for a new registration.\n(5) The cabinet shall not issue or renew a he alth care services agency registration if a\ncontrolling person's registration has not been renewed or has been revoked due to\nnoncompliance with requirements in KRS 216.718 to 216.728 for five (5) years\nfrom the date of nonrenewal or revocation.\n(6) A heal th care services agency may request a hearing in accordance with KRS\nChapter 13B to appeal a denial of an application for registration, revocation of\nregistration, or an imposed monetary penalty.","path":["KRS Chapter 216"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=52774","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:22Z","sha256":"10c9cd2e0b4ecbc7e78eb8d3e6b7f59d64a734c7c8fdbae014d79146ceaa7294","source_id":"us-ky","stale":false,"prev":"us-ky/krs-216.718","next":"us-ky/krs-216.722"},"notice":"GroundRules: Original legal text.
