{"data":{"id":"us-ky/krs-216.722","jurisdiction":"us-ky","citation":"KRS 216.722","heading":"Minimum requirements of health care services agency -- Penalties.","body":"(1) A health care services agency shall:\n(a) Retain documentation that each temporary direct care staff contracted with or\nemployed by the agency meets the minimum licensing, c ertification, training,\nand continuing education standards for his or her position;\n(b) Comply with all pertinent requirements relating to the health and other\nqualifications of personnel employed in assisted living communities, long -\nterm care facilities, or hospitals;\n(c) Carry all professional and general liability insurance coverage to insure\nagainst loss, damage, or expense incident to a claim arising out of the death or\ninjury of any person as the result of negligence or malpractice in the provision\nof direct care services by the health care services agency or any temporary\ndirect care staff;\n(d) Carry an employee dishonesty bond in the amount of ten thousand dollars\n($10,000);\n(e) Maintain coverage for workers' compensation for all temporary direct car e\nstaff; and\n(f) Retain all records for five (5) calendar years and make all records\nimmediately available to the cabinet upon request.\n(2) Failure to comply with subsection (1) of this section shall result in:\n(a) Denial of an application for registration or registration renewal; or\n(b) Revocation of registration and a monetary penalty in the amount of twenty -\nfive thousand dollars ($25,000).\n(3) If the cabinet determines that a health care services agency has knowingly provided\nto an assisted living community, a long -term care facility, or a hospital temporary\ndirect care staff who have illegally or fraudulently obtained or been issued a\ndiploma, registration, license, certification, or criminal background check, the\ncabinet shall immediately notify the agency that its registration will be revoked in\nfifteen (15) days.","path":["KRS Chapter 216"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=53777","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:22Z","sha256":"568bd8071ce4ed63fc832dd821c283a0afa9c8d7688373a3f71a2ca71db76c4a","source_id":"us-ky","stale":false,"prev":"us-ky/krs-216.720","next":"us-ky/krs-216.724"},"notice":"GroundRules: Original legal text.
