{"data":{"id":"us-ky/krs-216.724","jurisdiction":"us-ky","citation":"KRS 216.724","heading":"Restrictions on health care services agency -- Contracts.","body":"(1) A health care services agency shall not:\n(a) Restrict in any manner the employment opportunities of any temporary direct\ncare staff that is contracted with or employed by the agenc y, including but not\nlimited to contract buy-out provisions or contract non-compete clauses;\n(b) Require, in any contract with temporary direct care staff, an assisted living\ncommunity, a long-term care facility, or a hospital, the payment of liquidated\ndamages, employment fees, or other compensation should the employee be\nhired as a permanent employee of the assisted living community, long -term\ncare facility, or hospital, except in cases where the damages, fees, or\ncompensation are payable solely by the as sisted living community, long -term\ncare facility, or hospital and the contract with the assisted living community,\nlong-term care facility, or hospital specifies that the amount will be reduced\npro-rata based on the length of time the temporary direct care  staff performs\nservices for the assisted living community, long -term care facility, or hospital\nwhile on the payroll of the health care services agency; or\n(c) Solicit or recruit the current staff of an assisted living community, long -term\ncare facility, or hospital, or require, as a condition of employment,\nassignment, or referral, that their employees recruit new employees for the\nagency from among the current employees of the assisted living community,\nlong-term care facility, or hospital to which the a gency employees are\nemployed, assigned, or referred.\n(2) Any contract between a health care services agency and temporary direct care staff\nthat does not comply with subsection (1) of this section shall be considered an\nunfair trade practice and be void pursuant to KRS 365.060.\n(3) The provisions of subsection (1) of this section shall not apply to contracts with\npermanent direct care staff or with an assisted living community, a long -term care\nfacility, or a hospital for the placement of permanent direct care staff.","path":["KRS Chapter 216"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=53778","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:22Z","sha256":"e877bc66b92d23de47ccbf25600a028bb68113a3941279bc51761b217708bf86","source_id":"us-ky","stale":false,"prev":"us-ky/krs-216.722","next":"us-ky/krs-216.725"},"notice":"GroundRules: Original legal text.
