{"data":{"id":"us-ky/krs-216.789","jurisdiction":"us-ky","citation":"KRS 216.789","heading":"Prohibition against employing certain felons at long -term care facilities,","body":"health care services agencies providing staff to nursing facilities, or in assisted\nliving communities -- Preemployment check with Justice and Public Safety\nCabinet -- Temporary employment.\n(1) No long -term care facility as defined by KRS 216.535(1), health care services\nagency providing staff to a nursing facility, or assisted living community shall\nknowingly employ a person in a position which involves providing direc t care\nservices to a resident or client if that person has been convicted of a felony offense\nrelated to theft; abuse or sale of illegal drugs; abuse, neglect, or exploitation of an\nadult; or a sexual crime.\n(2) A nursing facility, health care services age ncy providing staff to a nursing facility,\nor assisted living community may employ persons convicted of or pleading guilty to\nan offense classified as a misdemeanor if the crime is not related to abuse, neglect,\nor exploitation of an adult.\n(3) Each long -term care facility as defined by KRS 216.535(1), health care services\nagency providing staff to a nursing facility, or assisted living community shall\nrequest all conviction information from the Justice and Public Safety Cabinet for\nany applicant for employment pursuant to KRS 216.793.\n(4) The long-term care facility, health care services agency providing staff to a nursing\nfacility, or assisted living community may temporarily employ an applicant pending\nthe receipt of the conviction information.","path":["KRS Chapter 216"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=52783","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:22Z","sha256":"4634942b3cebaa43283328de1dbcaf7ac78dda190425b493f7243eb5449e7fce","source_id":"us-ky","stale":false,"prev":"us-ky/krs-216.787","next":"us-ky/krs-216.793"},"notice":"GroundRules: Original legal text.
