{"data":{"id":"us-ky/krs-216.935","jurisdiction":"us-ky","citation":"KRS 216.935","heading":"Definitions for KRS 216.935 to 216.939.","body":"As used in KRS 216.935 to 216.939, unless the context requires otherwise:\n(1) \"Direct-care staff member\" means a home health aide or a personal service aide\nwhose work involves extensive contact with residents or program participants who\nexhibit symptoms of Alzheimer's disease or other dementias;\n(2) \"Facilities or programs\" means residential facilities or home -and-community-based\nservice programs and include but are not limited to personal service agencies and\nhome health agencies that have residents or pr ogram participants who exhibit\nsymptoms of Alzheimer's disease or other dementias;\n(3) \"Home health aide\" means an individual who is hired to perform home health aide\nservices;\n(4) \"Home health agency\" means a public agency or private organization, or a\nsubdivision of such an agency or organization which is licensed as a home health\nagency by the Cabinet for Health and Family Services and is certified to participate\nas a home health agency under Title XVIII of the Social Security Act;\n(5) \"Home health aide services\" means those services provided by a home health aide\nand supervised by a registered nurse which are directed towards the personal care of\nthe patient. Such services shall include but not be limited to the following:\n(a) Helping the patient with bath and care of mouth, skin, and hair;\n(b) Helping the patient to the bathroom or in using a bedpan;\n(c) Helping the patient in and out of bed and assisting with ambulation;\n(d) Helping the patient with prescribed exercises which the patient and home\nhealth aide have been taught by appropriate professional personnel;\n(e) Assisting with medication ordinarily self -administered that has been\nspecifically ordered by a physician, an advanced practice registered nurse, or a\nphysician assistant;\n(f) Performing inci dental household services as are essential to the patient's\nhealth care at home, if these services would have been performed if the patient\nwas in a hospital or skilled nursing facility; and\n(g) Reporting changes in the patient's condition or family situat ion to the\nprofessional nurse supervisor;\n(6) \"Nurse aide\" means an individual, including a nursing student, medication aide, and\na person employed through a nursing pool, who provides nursing or nursing related\nservices to a resident in a nursing facility or home health agency, excluding:\n(a) An individual who is a licensed health professional;\n(b) A volunteer who provides the nursing or nursing -related services without\nmonetary compensation; and\n(c) A person who is hired by the resident or family to sit with the resident and\nwho does not perform nursing or nursing-related services; and\n(7) \"Recipient\" means an individual receiving nonmedical home health services or\nmedical home-health services.","path":["KRS Chapter 216"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=51061","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:22Z","sha256":"4420c2299a2a165629a7f1d9e2039ee305ccc3faded3eb800616909f000f9c3f","source_id":"us-ky","stale":false,"prev":"us-ky/krs-216.930","next":"us-ky/krs-216.936"},"notice":"GroundRules: Original legal text.
