{"data":{"id":"us-ky/krs-216.941","jurisdiction":"us-ky","citation":"KRS 216.941","heading":"License or certificate requirements for voluntary provision of health","body":"care -- Registration -- Availability of information -- Report.\n(1) Notwithstanding any provision of law to the contrary, no additional license or\ncertificate otherwise required under the provisions of KRS  Chapters 211, 216,\n311, 312, or 314 shall be necessary for the voluntary provision of health care\nservices by any person who:\n(a) Is a charitable health care provider as defined in KRS 216.940; or\n(b) Does not regularly practice in the Commonwealth.\n(2) No  person whose  license or certificate is suspended  or revoked under\ndisciplinary proceedings in any jurisdiction, nor any person who  renders\nservices outside of the scope of practice authorized by his or her licensure or\ncertification or exception to license or certification shall be  allowed to\nparticipate with any sponsoring organization as a charitable health care\nprovider.\n(3) Before providing charitable health care services in this state, a charitable\nhealth care provider or sponsoring organization shall register with the Cabinet\nfor Health and Family Services by filing a registration form that shall contain the\nfollowing information:\n(a) The  name, address, and phone number  of the charitable health care\nprovider;\n(b) Written and  verifiable documentation of a current Kentucky license\nincluding, if applicable, a license granted to an individual under a\nreciprocal agreement with another state or country;\n(c) The name, principal office address, phone number, and principal officer of\nany sponsoring organization;\n(d) The  dates, locations, types of services, and intended recipients of any\ncharitable health care services to be performed in the state;\n(e) Information as to any medical malpractice insurance procured under KRS\n304.40-075 or otherwise; and\n(f) Other information as the cabinet may require by administrative regulation.\n(4) The cabinet shall provide, upon request of the charitable health care provider\nor  sponsoring organization, any  information available as  to declared\nemergencies, underserved populations, and lack of access to health care in the\nstate that will assist the charitable health care provider or sponsoring\norganization in the provision of these services.\n(5) Boards of health created under KRS  Chapter 212 may  submit requests for\ncharitable health care providers in their jurisdictions to be listed in any\ninformation provided.\n(6) Each  sponsoring organization shall maintain a list of health care providers\nassociated with its provision of charitable health care services. For each health\ncare provider, the sponsoring organization shall maintain a copy of a current\nlicense, certificate, or statement of exemption from licensure or certification and\nshall require each health care provider to attest in writing that his or her license\nor certificate is not suspended or revoked under disciplinary proceedings in any\njurisdiction. The sponsoring organization shall maintain its records of charitable\nhealth care providers for at least five (5) years after the provision of charitable\nhealth care services, including actual dates, types of services, and recipients of\ncharitable health care services, and shall furnish these records upon the\nrequest of the Cabinet for Health and Family Services. Compliance with this\nsection shall be prima facie evidence that the sponsoring organization has\nexercised due care in selecting charitable health care providers.\n(7) The cabinet may revoke the registration of any charitable health care provider\nor sponsoring organization for failure to comply with the provisions of KRS\n216.940 to 216.945, in accordance with the provisions of KRS Chapter 13B.\n(8) The  cabinet shall report the name  and location of individuals registered with\nthe cabinet as charitable health care providers upon request.","path":["KRS Chapter 216"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=46338","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:22Z","sha256":"592d228951805f79ab52d47044da6bc1e1ddf09bbe4c55b28943c4874e6253c5","source_id":"us-ky","stale":false,"prev":"us-ky/krs-216.940","next":"us-ky/krs-216.942"},"notice":"GroundRules: Original legal text.
