{"data":{"id":"us-ky/krs-216b.042","jurisdiction":"us-ky","citation":"KRS 216B.042","heading":"Licenses -- Authority to enter upon premises -- Authority for","body":"administrative regulations.\n(1) The cabinet shall:\n(a) Establish by promulgation of administrative regulation under KRS Chapter\n13A reasonable application fees for licenses and promulgate other\nadministrative regulations necessary for the proper administration of the\nlicensure function;\n(b) Issue, deny, revoke, modify, or suspend licenses or provisional licenses in\naccordance with the provisions of this chapter;\n(c) Establish licensure stan dards and procedures to ensure safe, adequate, and\nefficient abortion facilities, health facilities and health services. These\nregulations, under KRS Chapter 13A, shall include, but need not be limited to:\n1. Patient care standards and safety standards, mi nimum operating\nstandards, minimum standards for training, required licenses for medical\nstaff personnel, and minimum standards for maintaining patient records;\n2. Licensure application and renewal procedures; and\n3. Classification of health facilities and  health services according to type,\nsize, range of services, and level of care; and\n(d) Compile in a single document, maintain, and make available to abortion\nfacilities and the public during regular business hours, all licensure standards\nand procedures p romulgated under KRS Chapter 13A related to abortion\nfacilities.\n(2) The cabinet may authorize its agents or representatives to enter upon the premises\nof any health care facility for the purpose of inspection, and under the conditions set\nforth in adminis trative regulations promulgated under KRS Chapter 13A by the\ncabinet.\n(3) The cabinet may revoke licenses or certificates of need for specific health facilities\nor health services or recommend the initiation of disciplinary proceedings for health\ncare prov iders on the basis of the knowing violation of any provisions of this\nchapter.","path":["KRS Chapter 216B"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=9189","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:23Z","sha256":"d9b77c72354b6a45596eef98cc4c17b861b66b0b6399f2443296fecd9080731d","source_id":"us-ky","stale":false,"prev":"us-ky/krs-216b.0417","next":"us-ky/krs-216b.0422"},"notice":"GroundRules: Original legal text.
