{"data":{"id":"us-ky/krs-216b.066","jurisdiction":"us-ky","citation":"KRS 216B.066","heading":"Cabinet to be notified prior to acquiring certain major medical","body":"equipment, a health service is offered, or a capital expenditure is made or\nobligated -- Certificate of need may be required.\n(1) Before a health facility acquires major medical equipmen t to be used solely for\nresearch, offers a health service solely for research, or makes or obligates a capital\nexpenditure solely for research, which exceeds the prescribed minimum, the health\nfacility shall notify the cabinet of its intent to do so. The n otice shall be in writing\nand shall be made sixty (60) days prior to the acquisition, offering, or making or\nobligation of the expenditure with respect to which notice is given. The notice shall\nstate the use to be made of the major medical equipment, heal th service, or capital\nexpenditure.\n(2) A certificate of need shall be required for the acquisition of major medical\nequipment solely for research, the offering of a health service solely for research, or\nthe making or obligating of a capital expenditure s olely for research by a health\nfacility, only if:\n(a) The notice required by this section is not filed; or\n(b) The cabinet finds within sixty (60) days after it receives notice that the project\nor transaction for which notice is given will affect the charg es of the facility\nfor the provision of medical or other patient care services other than services\nwhich are included in the research, will substantially change the bed capacity\nof the facility, or will substantially change the medical or other patient car e\nservices of the facility which were offered before the acquisition, offering,\nmaking or obligation.\n(3) If major medical equipment is acquired, a health service is offered, or a capital\nexpenditure is made or obligated and, pursuant to this section, no c ertificate of need\nis required, the equipment, service, or facilities acquired through the capital\nexpenditure shall not be used in a manner which would affect the charges of the\nfacility for the provision of medical or other patient care services other th an that\nincluded in the research, substantially change the bed capacity of the facility, or\nsubstantially change the medical or other patient care services of the facility unless a\ncertificate of need is issued.\n(4) For purposes of this section, \"solely for research\" means patient care provided on an\noccasional and irregular basis and not as part of a research project.","path":["KRS Chapter 216B"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=9205","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:23Z","sha256":"e779d0a591fa44cf8a771271ad14ce11525711a3c055c266712e9486d8aaea63","source_id":"us-ky","stale":false,"prev":"us-ky/krs-216b.065","next":"us-ky/krs-216b.070"},"notice":"GroundRules: Original legal text.
