{"data":{"id":"us-ky/krs-216b.153","jurisdiction":"us-ky","citation":"KRS 216B.153","heading":"Surgical smoke evacuation system requirement.","body":"(1) As used in this section:\n(a) \"Energy-generating device\" means any tool that performs a surgical function\nusing heat, laser, electricity, or another form of energy;\n(b) \"Smoke evacuation system\" means smoke evacuators, laser plume evacuators,\nor local exhau st ventilators that effectively capture and neutralize surgical\nsmoke at the site of origin and before the smoke can make ocular contact or\ncontact with the respiratory tract of the occupants of the room; and\n(c) \"Surgical smoke\" means the by -product, incl uding surgical plume, smoke\nplume, bio -aerosols, laser -generated airborne contaminants, and other lung -\ndamaging dust, that results from contact with tissue by an energy -generating\ndevice.\n(2) On or before January 1, 2022, in order to protect operating room  nurses, operating\nroom personnel, and patients from the hazards of surgical smoke, the cabinet shall\npromulgate administrative regulations in accordance with KRS Chapter 13A\nrequiring a health facility licensed under this chapter that utilizes energy -generating\ndevices to make use of a smoke evacuation system during any surgical procedure\nthat is likely to produce surgical smoke.","path":["KRS Chapter 216B"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=51017","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:23Z","sha256":"b552255d50e4c0899f49c2e2f1dce30cf4641cf81c4ef9c0ac81a786e93f4181","source_id":"us-ky","stale":false,"prev":"us-ky/krs-216b.150","next":"us-ky/krs-216b.155"},"notice":"GroundRules: Original legal text.
