{"data":{"id":"us-ky/krs-216b.185","jurisdiction":"us-ky","citation":"KRS 216B.185","heading":"Accreditation as evidence of compliance with licensing requirements --","body":"Exemption from inspection -- Fees -- Submission of building plans -- Standards\nfor licensure.\n(1) The Office of the Inspector General shall accept accreditation by the Joint\nCommission or another nationally recognized accrediting organization with\ncomparable standards and survey processes, that has been approved by the United\nStates Centers on Medicare and Medicaid Services, as evidence that a hospital\ndemonstrates compliance wit h all licensure requirements under this chapter. An\nannual on-site licensing inspection of a hospital shall not be conducted if the Office\nof the Inspector General receives from the hospital:\n(a) A copy of the accreditation report within thirty (30) days o f the initial\naccreditation and all subsequent reports; or\n(b) Documentation from a hospital that holds full accreditation from an approved\naccrediting organization on or before July 15, 2002.\n(2) Nothing in this section shall prevent the Office of the Ins pector General from\nmaking licensing validation inspections and investigations as it deems necessary\nrelated to any complaints. The cabinet shall promulgate the necessary administrative\nregulations to implement the licensing validation process. Any adminis trative\nregulations shall reflect the validation procedures for accredited hospitals\nparticipating in the Medicare program.\n(3) A hospital shall pay any licensing fees required by the cabinet in order to maintain a\nlicense.\n(4) A new hospital shall not be exempt from the on -site inspection until meeting the\nrequirements of subsection (1) of this section and administrative regulations\npromulgated under KRS 216B.040, 216B.042, and 216B.105 for acute, critical\naccess, psychiatric, and rehabilitation facility requirements.\n(5) Before beginning construction for the erection of a new building, the alteration of\nan existing building, or a change in facilities for a hospital, the hospital shall submit\nplans to the Office of Inspector General for approval.\n(6) To the  extent possible, the cabinet shall consider all national standards when\npromulgating administrative regulations for hospital licensure.","path":["KRS Chapter 216B"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=44046","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:23Z","sha256":"9591e9a2b389f7b7dee3c16d5a3920f85c0cd225b9ffb57fa4c36e9ee6313cfe","source_id":"us-ky","stale":false,"prev":"us-ky/krs-216b.182","next":"us-ky/krs-216b.190"},"notice":"GroundRules: Original legal text.
