{"data":{"id":"us-ky/krs-216b.250","jurisdiction":"us-ky","citation":"KRS 216B.250","heading":"Health facility to furnish itemized statement of charges on request of","body":"paying patient.\n(1) For purposes of this section, \"paying patient\" means persons receiving health care\nservices who pay directly for services rendered, patients with private healt h\ninsurance or health maintenance organization coverage, persons receiving Medicaid\nor Medicaid benefits under Title XVIII and Title XIX of the Social Security Act and\npersons receiving veteran's health care benefits. \"Paying patient\" does not include\nmedically indigent persons with no source of payment whatsoever.\n(2) (a) When a copy of an itemized statement is requested by any paying patient, each\nhealth facility shall furnish to the patient within thirty (30) days of the patient's\ndischarge or within fif teen (15) days of the patient's request, whichever is\nlater, one (1) copy free of charge of the itemized statement of services\nrendered and charges incurred by the patient.\n(b) A summary statement of services rendered and charges incurred by the patient\nshall be included with the invoice sent by a health facility to the patient. Each\ninvoice shall indicate that an itemized statement may be obtained upon\nrequest. The Cabinet for Human Resources shall impose a civil fine of five\nhundred dollars ($500) for each violation by a health care facility for failure to\nprovide an itemized statement as required under this section.\n(c) The itemized statement shall be stamped \"Kentucky Revised Statutes prohibit\nthe use of this statement for insurance payment purposes wher e benefits have\nbeen assigned.\"\n(3) Each health facility shall post in a publicly visible place in their admission,\noutpatient areas and, where applicable, emergency areas that an itemized statement\nis available to any paying patient upon request.\n(4) The itemized statement rendered shall be the record maintained by the health\nfacility that details the charges made for services rendered to patients and shall\nindicate whether an assignment of benefits has been obtained.\n(5) Each health facility shall designa te and make available appropriate staff to provide,\nupon patient request, an explanation of charges listed in the itemized statement.\n(6) If a health facility knows of a discrepancy in the total charges as reported in an\nitemized statement and that which i s reported to a third party payor, or at any time\nthat a health facility becomes aware of such a discrepancy, the health facility shall\nprovide the patient and third party payor with notification, an explanation and, if\napplicable, any reconciliation of the discrepancy in total charges.","path":["KRS Chapter 216B"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=9240","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:24Z","sha256":"270ab31d7636ccd9620e4ab33304968e234de7fafc3d7ea7fde75aa04635438b","source_id":"us-ky","stale":false,"prev":"us-ky/krs-216b.239","next":"us-ky/krs-216b.300"},"notice":"GroundRules: Original legal text.
