{"data":{"id":"us-ky/krs-216b.303","jurisdiction":"us-ky","citation":"KRS 216B.303","heading":"Rights of residents of boarding homes.","body":"Every resident in a boarding home, as defined in KRS 216B.300, shall have at least the\nfollowing rights:\n(1) Before entering a boarding home, the resident or the resident's guardian, if any, shall\nbe fully informed in writing, as evidenced by the resident's written acknowledgment\nor that of the resident's guardian, of all services provided by the boarding home and\nall applicable charges.\n(2) Before entering a boarding home, the resident or the resident's guardian shall be\nfully informed in writing, as evidenced by the resident's written acknowledgment or\nthat of the resident's guardian, of all the resident's rights as defined in this section,\nand a list of any rules established by the boarding home.\n(3) All residents shall be allowed to exercise their rights  as a resident and a citizen, and\nmay voice grievances and recommend changes in policies and services to the\nboarding home operator and to outside representatives of their choice, free from\nrestraint, interference, coercion, discrimination, or reprisal.\n(4) All residents shall be free from mental and physical abuse.\n(5) Each resident may manage the use of his personal funds. The boarding home\noperator shall not require a resident to designate the operator as payee for any\nbenefits received by the resident. However, if the operator accepts the responsibility\nfor managing the resident's personal funds as evidenced by the operator's written\nacknowledgment, proper accounting and monitoring of such funds shall be made.\nThis shall include the operator giving quart erly itemized statements to the resident\nor the resident's guardian which detail the status of the resident's personal funds and\nany transactions in which such funds have been received or disbursed. The operator\nshall return to the resident his valuables, personal possessions, and any unused\nbalance of moneys from his account at the time the resident leaves the boarding\nhome.\n(6) Residents shall not be required to perform services for the boarding home.\n(7) Residents may associate and communicate privately with persons of their choice,\nwithin reasonable hours established by the boarding home, and send and receive\npersonal mail unopened.\n(8) No resident shall be detained against the resident's will. Residents shall be permitted\nand encouraged to go outdoors and leave the premises as they wish.\n(9) Residents shall be permitted to participate in activities of social, religious, and\ncommunity groups at their discretion.\n(10) Residents shall be assured of at least visual privacy in multibed rooms and in\nbathrooms.\n(11) If the resident has been adjudicated wholly mentally disabled in both financial and\npersonal affairs in accordance with KRS 387.590, the resident's guardian shall not\nplace the ward in a boarding home.\n(12) Each resident shall be treated with consideration, respect, and full recognition of his\ndignity and individuality.\n(13) Residents shall have access to a telephone at a convenient location within the\nboarding home for making and receiving telephone calls subject to reasonable rules\nestablished by the boarding home.\n(14) Residents have the right to have private meetings with inspectors representing the\nCabinet for Health and Family Services.\n(15) Each resident and his guardian has the right to have access to all inspection reports\non the boarding home.","path":["KRS Chapter 216B"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=9242","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:24Z","sha256":"2485e5c662c7fcb9de64e8a719411c4816203f14af1d23999ffbdb0d6c60558e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-216b.300","next":"us-ky/krs-216b.305"},"notice":"GroundRules: Original legal text.
