{"data":{"id":"us-ky/krs-216b.306","jurisdiction":"us-ky","citation":"KRS 216B.306","heading":"Procedures, remedies, and penalties for operation of boarding home","body":"without registration.\n(1) When the cabinet has reasonable cause to believe that any person, association,\nbusiness entity, or organization is operating a boarding home without a regist ration,\nthe cabinet may:\n(a) Issue and deliver a notice to cease and desist from the violations;\n(b) Issue and deliver a notice to cease and desist to any person who aids and abets\nthe operation of a boarding home that is not registered; and\n(c) Impose a c ivil penalty of at least one thousand dollars ($1,000) but not more\nthan five thousand dollars ($5,000) upon the person, association, business\nentity, or organization that operates a boarding home that is not registered by\nthe cabinet.\n(2) Issuance of a no tice under subsection (1) of this section shall not constitute agency\naction for which a hearing under KRS Chapter 13B may be sought.\n(3) For the purpose of enforcing a cease and desist order and penalties under subsection\n(1) of this section, the cabinet may file a proceeding in the name of the\nCommonwealth seeking issuance of an injunction and enforcement of penalties\nagainst any person who violates subsection (1) of this section.\n(4) In addition to the remedies under subsection (1) of this section, the c abinet may\nimpose a civil penalty of at least one thousand dollars ($1,000) but not more than\nfive thousand dollars ($5,000) upon the person, association, business, entity, or\norganization who aids and abets the operation of a boarding home that is not\nregistered. If the cabinet is required to seek enforcement of the cease and desist\norder, it shall be entitled to collect attorney's fees, costs, and any expenses incurred\nby the cabinet or local government as a consequence of and incident to the\nrelocation of boarders to appropriate housing.","path":["KRS Chapter 216B"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=9244","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:24Z","sha256":"359560d338f019d89cbb7f234758a5e0b661b15ead0830a36ae9da6dffa45488","source_id":"us-ky","stale":false,"prev":"us-ky/krs-216b.305","next":"us-ky/krs-216b.310"},"notice":"GroundRules: Original legal text.
