{"data":{"id":"us-ky/krs-216b.332","jurisdiction":"us-ky","citation":"KRS 216B.332","heading":"Requirements for certificate of compliance -- Assessment of residents in","body":"nursing home beds -- Limitations upon admission to nursing home beds --\nMove-out notice and alternative living arrangements -- Certificate of need not\nrequired to provide home health services to on-campus residents.\n(1) To be eligible for a certificate of compliance, a continuing care retirement\ncommunity shall certify in writing to the cabinet and shall disclose in writing to\neach of its residents that:\n(a) None of the health facilities or health services operated by the continuing care\nretirement community shall apply for or become certified for participation in\nthe Medicaid program; and\n(b) No claim for Medicaid reimbursement shall be submitted for any person for\nany health service provided by the continuing care retirement community.\n(2) A continuing care retirement community may establish one (1) bed at the nursing\nhome level of care for every four (4) living units or personal care beds operated by\nthe continuing care retire ment community collectively. All residents in nursing\nhome beds shall be assessed using the Health Care Financing Administration or\nCenters for Medicare and Medicaid Services approved long -term care resident\nassessment instrument.\n(3) Admissions to continu ing care retirement community nursing home beds shall be\nexclusively limited to on -campus residents. A resident shall not be admitted to a\ncontinuing care retirement community nursing home bed prior to ninety (90) days of\nresidency in the continuing care r etirement community unless the resident\nexperiences a significant change in health status documented by a physician. No\nresident admitted to a nursing home bed shall be transferred or discharged without\nthirty (30) days prior written notice to the resident or his or her guardian.\n(4) A continuing care retirement community shall assist each resident upon a move -out\nnotice to find appropriate living arrangements. Each continuing care retirement\ncommunity shall share information on alternative living arrangeme nts provided by\nthe Department for Aging and Independent Living at the time a move -out notice is\ngiven to a resident. The written agreement executed by the resident and the\ncontinuing care retirement community shall contain provisions for assisting any\nresident who has received a move -out notice to find appropriate living\narrangements, prior to the actual move-out date.\n(5) Home health services provided by a continuing care retirement community to its on-\ncampus residents shall not require a certificate of need.","path":["KRS Chapter 216B"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=40484","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:24Z","sha256":"9292c77ac5a91ce1c6dd132ac8495d6dafc5cf488da2eb696bf0b0f76bddc42e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-216b.330","next":"us-ky/krs-216b.335"},"notice":"GroundRules: Original legal text.
