{"data":{"id":"us-ky/krs-216b.450","jurisdiction":"us-ky","citation":"KRS 216B.450","heading":"Definitions for KRS 216B.450, 216B.455, and 216B.457.","body":"As used in this section and KRS 216B.455 and 216B.457:\n(1) \"Cabinet\" means the Cabinet for Health and Family Services;\n(2) \"Community-based\" means a facility that is located in an existing residential\nneighborhood or community;\n(3) \"Freestanding\" means a c ompletely detached building or two (2) residences under\none (1) roof that are clearly separate and can serve youth independently;\n(4) \"Home-like\" means a residence with living space designed to accommodate the\ndaily living needs and tasks of a family unit,  with opportunity for adult -child\ncommunication, shared tasks, adult -child learning, congregate meals, and family -\ntype routines appropriate to the ages and levels of functioning of the residents;\n(5) \"Psychiatric residential treatment facility\" means either a licensed:\n(a) Level I community-based, and home-like facility with a maximum of nine (9)\nbeds which provides inpatient psychiatric residential treatment to residents age\nsix (6) to twenty -one (21) years who have an emotional disability or severe\nemotional disability as defined in KRS 200.503, with an age range of no\ngreater than five (5) years at the time of admission in a living unit; or\n(b) Level II home -like facility that provides twenty -four (24) hour inpatient\npsychiatric residential treatment and habitation to persons who:\n1. Are ages four (4) to twenty -one (21) years, with an age range of no\ngreater than five (5) years at the time of admission to the facility;\n2. Have a severe emotional disability as defined by KRS 200.503 in\naddition to severe an d persistent aggressive behaviors, intellectual\ndisability, sexually acting out behaviors, or developmental disability;\nand\n3. Do not meet the medical necessity criteria for an acute care hospital or a\npsychiatric hospital and whose treatment needs cannot be met in an\nambulatory care setting, Level I psychiatric residential treatment facility,\nor other less restrictive environment;\n(6) \"Qualified mental health personnel\" means a staff member who operates under the\nsupervision of a qualified mental health professional; and\n(7) \"Qualified mental health professional\" has the same meaning as in KRS 202A.011.","path":["KRS Chapter 216B"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=9255","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:24Z","sha256":"ecea8c1bd12be795b0ee9a7a39088c6fdfee88b2f22e0e1e96944a9f9cd842f3","source_id":"us-ky","stale":false,"prev":"us-ky/krs-216b.410","next":"us-ky/krs-216b.455"},"notice":"GroundRules: Original legal text.
