{"data":{"id":"us-ky/krs-216b.990","jurisdiction":"us-ky","citation":"KRS 216B.990","heading":"Penalties.","body":"(1) Any person who, in willful violation of this chapter, operates a health facility or\nabortion facility without first obtaining a license or continues to operate a health\nfacility or abortion facility after a final decision suspending or revoking a license\nshall be fined not less than five hundred dollars ($500) nor more than ten thousand\ndollars ($10,000) for each violation.\n(2) Any person who, in willful violation of this chapter, acquires major medical\nequipment, establishes a health facility, or obligates  a capital expenditure without\nfirst obtaining a certificate of need, or after the applicable certificate of need has\nbeen withdrawn, shall be fined one percent (1%) of the capital expenditure involved\nbut not less than five hundred dollars ($500) for each violation.\n(3) Any health care provider or hospital acting by or through its agents or employees\nwhich violates any provision of KRS 216B.400 shall be punished by a fine of not\nless than one hundred dollars ($100) nor more than five hundred dollars ($500). The\ncabinet shall establish an online portal on its website for reporting violations of\nKRS 216B.400.\n(4) Any health facility which willfully violates KRS 216B.250 shall be fined one\nhundred dollars ($100) per day for failure to post required notices and  one hundred\ndollars ($100) per instance for willfully failing to provide an itemized statement\nwithin the required time frames.\n(5) In addition to the civil penalties established under KRS 216B.306(1) and (4), any\nperson who advertises, solicits boarders,  or operates a boarding home without first\nobtaining a registration as required by KRS 216B.305 and any person who aids or\nabets the operation of a boarding home that is not registered shall be imprisoned for\nno more than twelve (12) months.\n(6) Any person  or entity establishing, managing, or operating an abortion facility or\nconducting the business of an abortion facility which otherwise violates any\nprovision of this chapter or any administrative regulation promulgated thereunder\nregarding abortion facili ties shall be subject to revocation or suspension of the\nlicense of the abortion facility. In addition, any violation of any provision of this\nchapter regarding abortion facilities or any administrative regulation related thereto\nby intent, fraud, deceit, unlawful design, willful and deliberate misrepresentation, or\nby careless, negligent, or incautious disregard for the statute or administrative\nregulation, either by persons acting individually or in concert with others, shall\nconstitute a violation and sh all be punishable by a fine not to exceed one thousand\ndollars ($1,000) for each offense. Each day of continuing violation shall be\nconsidered a separate offense. The venue for prosecution of the violation shall be in\nany county of the state in which the violation, or any portion thereof, occurred.\n(7) Any hospital acting by or through its agents or employees that violates any\nprovision of KRS 216B.150 shall be punished by a fine of not less than one hundred\ndollars ($100) nor more than five hundred dollars ($500) for each violation.\n(8) Any health facility acting by or through its agents or employees that violates any\nprovision of KRS 216B.153 shall be punished by a fine of not less than one hundred\ndollars ($100) nor more than five hundred dollars ($500) for each violation.","path":["KRS Chapter 216B"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=54918","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:24Z","sha256":"cf133f8808f1700f3d6db993dc212b106d032c72dc59f385ed4b8d79ce317fa0","source_id":"us-ky","stale":false,"prev":"us-ky/krs-216b.459","next":"us-ky/krs-216c.005"},"notice":"GroundRules: Original legal text.
