{"data":{"id":"us-ky/krs-217.025","jurisdiction":"us-ky","citation":"KRS 217.025","heading":"When food deemed adulterated.","body":"A food shall be deemed to be adulterated:\n(1) (a) If it bears or contains any poisonous or deleterious substance which may\nrender it injurious to health; but in case the substance is not an added\nsubstance such food shall not be considered adulterated under this subsection\nif the quantity of such sub stance in such food does not ordinarily render it\ninjurious to health; or\n(b) If it bears or contains any added poisonous or added deleterious substance\nwhich is unsafe within the meaning of KRS 217.045; or\n(c) If it consists in whole or in part of a disea sed, contaminated, filthy, putrid, or\ndecomposed substance, or if it is otherwise unfit for food; or\n(d) If it has been produced, prepared, packed, or held under insanitary conditions\nwhereby it may have become contaminated with filth, or whereby it may ha ve\nbeen rendered diseased, unwholesome, or injurious to health; or\n(e) If it is the product of a diseased animal or an animal which has died otherwise\nthan by slaughter, or that has been fed upon the uncooked offal from a\nslaughterhouse; or\n(f) If its cont ainer is composed, in whole or in part, of any poisonous or\ndeleterious substance which may render the contents injurious to health;\n(2) (a) If any valuable constituent has been in whole or in part omitted or abstracted\ntherefrom; or\n(b) If any substance has been substituted wholly or in part therefor; or\n(c) If damage or inferiority has been concealed in any manner; or\n(d) If any substance has been added thereto or mixed or packed therewith so as to\nincrease its bulk or weight, or reduce its quality or str ength or make it appear\nbetter or of greater value than it is;\n(3) If it is confectionery and it bears or contains any nonnutritive article or substance\nexcept harmless coloring, harmless flavoring, harmless resinous glaze not in excess\nof four-tenths of o ne percent (0.4%), harmless natural wax not in excess of four -\ntenths of one percent (0.4%), harmless natural gum, and pectin; provided that this\nsubsection shall not apply to any chewing gum by reason of its containing harmless\nnonnutritive masticatory substances;\n(4) If it bears or contains a coal -tar color other than one from a batch which has been\ncertified under authority of the federal act;\n(5) If it is filled milk.","path":["KRS Chapter 217"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=9267","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:24Z","sha256":"22d25056bd6b77f0f072d18dd414a171fed34692cfc1f8919ea46eb35808c1fe","source_id":"us-ky","stale":false,"prev":"us-ky/krs-217.020","next":"us-ky/krs-217.030"},"notice":"GroundRules: Original legal text.
