{"data":{"id":"us-ky/krs-217.039","jurisdiction":"us-ky","citation":"KRS 217.039","heading":"Ingestible or cosmetic cannabidiol products -- Manufacturer or processor","body":"to be permitted -- Labeling and certificate of analysis requirements --\nCannabis-infused beverages.\n(1) As used in this section:\n(a) \"Cannabidiol\" means a non -psychoactive cannabinoid found in the hemp\nplant Cannabis sativa which has the chemical name 2 -[(1R,6R)-3-methyl-6-\nprop-1-en-2-ylcyclohex-2-en-1-yl]-5-pentylbenzene-1,3-diol;\n(b) \"Certificate of analysis\" means a document produced by a laboratory that has\nbeen acc redited pursuant to standards of the International Organization for\nStandardization, attesting to the composition of a product. The certificate of\nanalysis shall include but not be limited to the amount of delta -9\ntetrahydrocannabinol, the amount of other cannabinoids, the amount of\npesticide residues, the amount of heavy metal traces, the amount of mycotoxin\ncontaminants, the amount of residual solvents, and the amount of\nmicrobiological contaminants;\n(c) \"Hemp\" has the same meaning as in KRS 260.850; and\n(d) \"Quick response code\" or \"QR code\" means a type of machine -readable, two\n(2) dimensional bar code that stores information about a product.\n(2) A manufacturer or processor of ingestible or cosmetic cannabidiol products located\nin Kentucky shall:\n(a) Be permitted as a food manufacturer or a cosmetic manufacturer by the\ncabinet and shall provide the following information:\n1. The name of the manufacturer or processor and the physical address\nwhere production or processing occurs; and\n2. A listing of the cannabidiol products to be produced or processed; and\n(b) Obtain a certificate of analysis for all cannabidiol products to be sold or\notherwise distributed in the Commonwealth.\n(3) All ingestible or cosmetic cannabidiol products sold or ot herwise distributed in the\nCommonwealth shall bear labeling to allow the consumer to access information on\nthe product, including a certificate of analysis for the product, the location where\nthe hemp was grown, and the address and phone number of the manu facturer or\ndistributor using the following:\n(a) A scannable bar code, including the batch number or serial number of the\nproduct;\n(b) A QR code; or\n(c) A web address linked to a document or website.\n(4) Any product labeling or advertising material for any  ingestible or cosmetic\ncannabidiol product sold or otherwise distributed in the Commonwealth shall not\nbear any claims stating that the product can diagnose, treat, cure, or prevent any\ndisease.\n(5) The cabinet shall promulgate administrative regulations in accordance with KRS\nChapter 13A to establish labeling requirements for ingestible or cosmetic\ncannabidiol products in accordance with of this section.\n(6) (a) The cabinet shall regulate and license manufacturers of cannabis -infused\nbeverages.\n(b) After the Department of Alcoholic Beverage Control has promulgated\nadministrative regulations under KRS 243.401 or July 1, 2026, whichever is\nearlier, this section shall not apply to any distributor or retailer of cannabis -\ninfused beverages licensed under KRS Ch apters 241 to 244. The distribution\nand retail sale of cannabis -infused beverages shall then be regulated solely by\nthe Department of Alcoholic Beverage Control under KRS Chapter 243 and\nthe administrative regulations promulgated thereto.","path":["KRS Chapter 217"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=55947","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:24Z","sha256":"e47425afbe94eb3984d9dd1cc695889454b1f9e43140ac52d3aa9d5b166aa577","source_id":"us-ky","stale":false,"prev":"us-ky/krs-217.037","next":"us-ky/krs-217.040"},"notice":"GroundRules: Original legal text.
