{"data":{"id":"us-ky/krs-217.085","jurisdiction":"us-ky","citation":"KRS 217.085","heading":"When cosmetic deemed adulterated.","body":"A cosmetic shall be deemed to be adulterated:\n(1) If it bears or contains any poisonous or deleterious substance which may render it\ninjurious to users under the conditions of use prescribed in the labeling or\nadvertisement thereof, or under such condition s of use as are customary or usual;\nprovided that this provision shall not apply to coal -tar hair dye, the label of which\nbears the following legend conspicuously displayed thereon: \"Caution -- This\nproduct contains ingredients which may cause skin irritat ion on certain individuals\nand a preliminary test according to accompanying directions should first be made.\nThis product must not be used for dyeing the eyelashes or eyebrows; to do so may\ncause blindness,\" and the labeling of which bears adequate directi ons for such\npreliminary testing. For the purpose of this subsection and subsection (5) of this\nsection, the term \"hair dye\" shall not include eyelash dyes or eyebrow dyes;\n(2) If it consists in whole or in part of any filthy, putrid or decomposed substance;\n(3) If it has been produced, prepared, packed, or held under insanitary conditions\nwhereby it may have become contaminated with filth, or whereby it may have been\nrendered injurious to health;\n(4) If its container is composed, in whole or in part, of an y poisonous or deleterious\nsubstance which may render the contents injurious to health;\n(5) If it is not a hair dye and it bears or contains a coal -tar color other than one from a\nbatch which has been certified under authority of the federal act.","path":["KRS Chapter 217"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=9280","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:24Z","sha256":"e2d5f881cbe0ba3cbacb0b1ae564eab8896d4e0335879671ea5ce4ca2cfa1808","source_id":"us-ky","stale":false,"prev":"us-ky/krs-217.080","next":"us-ky/krs-217.090"},"notice":"GroundRules: Original legal text.
