{"data":{"id":"us-ky/krs-217.105","jurisdiction":"us-ky","citation":"KRS 217.105","heading":"When advertising deemed false.","body":"(1) An advertisement of a food, drug, device, or cosmetic shall be deemed to be false if\nit is false or misleading in any particular.\n(2) For the purpose of KRS 217.005 to 217.215 the advertisement of a drug or device\nrepresenting it to have any effect in albu minuria, appendicitis, arteriosclerosis,\nblood poison, bone disease, Bright's disease, cancer, carbuncles, cholecytitis,\ndiabetes, diphtheria, dropsy, erysipelas, gallstones, heart and vascular diseases, high\nblood pressure, mastoiditis, measles, meningiti s, mumps, nephritis, otitis media,\nparalysis, pneumonia, poliomyelitis (infantile paralysis), prostate gland disorders,\npyelitis, scarlet fever, sexual impotence, sinus infection, smallpox, tuberculosis,\ntumors, typhoid, uremia, venereal disease, shall als o be deemed to be false, except\nthat no advertisement not in violation of subsection (1) of this section shall be\ndeemed to be false under this subsection if it is disseminated only to practitioners or\nappears only in the scientific periodicals of these pr actitioners, or is disseminated\nonly for the purpose of public health education by persons not commercially\ninterested, directly or indirectly, in the sale of such drugs or devices; provided that\nwhenever the secretary determines that an advance in medical science has made any\ntype of self -medication safe as to any of the diseases named above, the secretary\nshall by regulation authorize the advertisement of drugs having curative or\ntherapeutic effect for such disease, subject to such conditions and restrict ions as the\nsecretary may deem necessary in the interests of public health; provided that this\nsubsection shall not be construed as indicating that self -medication for diseases\nother than those named herein is safe or efficacious.","path":["KRS Chapter 217"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=9284","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:24Z","sha256":"3e28297b6638d428a91dd2b96d6db93f6ca71434eb417e2233c1c4dc0749c606","source_id":"us-ky","stale":false,"prev":"us-ky/krs-217.100","next":"us-ky/krs-217.110"},"notice":"GroundRules: Original legal text.
