{"data":{"id":"us-ky/krs-217.136","jurisdiction":"us-ky","citation":"KRS 217.136","heading":"Home -based processors of food and cosmetic products -- Exemption from","body":"permit requirement and fair packaging and labeling laws -- Production,\nlabeling, and sales of home -processed products -- Inspections -- Registration\nwith cabinet.\n(1) A home-based processor shall be exempt from KRS 217.035, 217.037, and 217.095\nif the following conditions are met:\n(a) All finished product containers are clean, sanitary, and properly labeled\npursuant to subsection (3) of this section;\n(b) All home -processed f oods or pork lard or tallow -based cosmetic products\nproduced under this exemption are neither adulterated nor misbranded\npursuant to subsection (4) of this section; and\n(c) All glass containers for jams, jellies, preserves, fruit butter, and similar\nproducts are provided with suitable rigid metal covers.\n(2) A home-based processor shall not produce or process for sale acid foods, acidified\nfood products, formulated acid food products, or low-acid canned foods.\n(3) A home -based processor shall label each of its food or cosmetic products and\ninclude the following information on the label of each of its food or cosmetic\nproducts:\n(a) The name and address of the home-based processing operation;\n(b) The common or usual name of the food or cosmetic product;\n(c) The ingredients of the food or cosmetic product, in descending order of\npredominance by weight;\n(d) The net weight and volume of the food or cosmetic product by standard\nmeasure, or numerical count;\n(e) The following statement in ten (10) point type: \"This product is home -\nproduced and processed\"; and\n(f) The date the product was processed.\n(4) Food or cosmetic products identified in KRS 217.015(56) and not labeled in\naccordance with subsection (3) of this section are deemed misbranded.\n(5) Food or cosmetic products identified in KRS 217.015(56) and produced, processed,\nand labeled in accordance with subsection (3) of this section are acceptable food or\ncosmetic products that may only be offered for sale di rectly to consumers within\nthis state, including from the home -based processor's home, whether by pick -up or\ndelivery, at a market, roadside stand, community event, or online. These food\nproducts may be used in preparing and serving food.\n(6) Food products  identified in KRS 217.015(56) and labeled in accordance with\nsubsection (3) of this section shall not be required to be tested in determining\nwhether or not the food product is an acid food, acidified food product, formulated\nacid food product, or low-acid food.\n(7) The processing facilities of a home -based processor may be inspected annually by\nthe cabinet.\n(8) A home-based processor shall be subject to product sampling and inspection if it is\ndetermined that its product is misbranded pursuant to subsecti on (4) of this section\nor adulterated, or if a consumer complaint has been received.\n(9) If the cabinet has reason to believe that an imminent health hazard exists it may\ninvoke cessation of production until it deems that the hazardous situation has been\naddressed to the satisfaction of the cabinet.\n(10) The cabinet shall promulgate administrative regulations to further delineate which\nfood or cosmetic products are subject to the definition of home -based processor, as\ndefined in KRS 217.015(56).\n(11) A home -based processor shall be registered with the cabinet and include the\nfollowing information:\n(a) The name of the home -based processor and the physical address where\nproduction or processing will occur; and\n(b) A listing of the food or cosmetic products to be produced or processed.","path":["KRS Chapter 217"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57382","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:25Z","sha256":"d9c6baa89da80d8e7ec289327356b618b7e8f7f2331b9a9b83c2e77dcc86f066","source_id":"us-ky","stale":false,"prev":"us-ky/krs-217.135","next":"us-ky/krs-217.137"},"notice":"GroundRules: Original legal text.
