{"data":{"id":"us-ky/krs-217.145","jurisdiction":"us-ky","citation":"KRS 217.145","heading":"When additives deemed unsafe.","body":"(1) A food additive shall with respect to any particular use or intended use of such\nadditive, be deemed to be unsafe within the meaning of KRS 217.025(1)(b) and\n217.045, unless it and its use or intended use conform to the terms of an exemption\nas provided un der the federal act, or, a regulation issued under the federal act\nprescribing the conditions under which such additive may be safely used.\n(2) Any poisonous or deleterious pesticide chemical, or any pesticide chemical which is\nnot recognized by the cabine t as safe for use, added to a raw agricultural\ncommodity, shall be deemed unsafe within the meaning of KRS 217.025(1)(b),\nunless a tolerance for such pesticide chemical in or on the raw agricultural\ncommodity has been prescribed under the federal act or th e Federal Environmental\nPesticide Control Act of 1972 and the quantity of such pesticide chemical in or on\nthe raw agricultural commodity is within the tolerance so prescribed or the pesticide\nchemical has been exempted from the requirement of a tolerance under provisions\nof the federal act or the Federal Environmental Pesticide Control Act of 1972.\n(3) A color additive shall with respect to any particular use (for which it is being used\nor intended to be used or is represented as suitable) in or on food or  drugs or\ncosmetics, be deemed unsafe for the purposes of the application of KRS 217.025(4),\n217.055(1)(d), or 217.085(5), as the case may be, unless there is in effect, and such\ncolor additive and such use are in conformity with a regulation as provided u nder\nthe federal act, or such color additive and such use conform to the terms of an\nexception under the federal act.","path":["KRS Chapter 217"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=9300","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:25Z","sha256":"12e53e8aa007e82d6c481046aad1ae4adf8779fe47666fb550da91b3c341a79b","source_id":"us-ky","stale":false,"prev":"us-ky/krs-217.140","next":"us-ky/krs-217.150"},"notice":"GroundRules: Original legal text.
