{"data":{"id":"us-ky/krs-217.155","jurisdiction":"us-ky","citation":"KRS 217.155","heading":"Cabinet's right of inspection and to carry out statutory provisions and","body":"regulations through local health departments -- Requirement that drug\ninspector be a pharmacist.\n(1) The cabinet or its duly authorized agent shall have free access at all reasona ble\ntimes to any factory, warehouse, or establishment in which foods, drugs, devices, or\ncosmetics are manufactured, processed, packed, or held for sale, or are held after\nreceipt in commerce, or to enter any vehicle being used to transport or hold the\nfoods, drugs, devices, or cosmetics in commerce, for the purpose:\n(a) Of inspecting the factory, warehouse, establishment, or vehicle and all\npertinent equipment, finished and unfinished materials, containers, and\nlabeling thereon, to determine if any of the provisions of KRS 217.005 to\n217.215 are being violated;\n(b) Of securing samples or specimens of any food, drug, device, or cosmetic after\npaying or offering to pay for the sample. The cabinet shall make or cause to be\nmade examinations of samples secured under the provisions of this section to\ndetermine whether or not any provision of KRS 217.005 to 217.215 is being\nviolated; and\n(c) Of examining or reproducing books, papers, documents, or other evidence\npertaining to the foods, drugs, cosmetics, or devices.\n(2) Any inspector appointed for the purpose of administering and carrying out the\nprovisions of KRS 217.005 to 217.215 insofar as they relate to drugs in a retail\npharmacy shall be a registered pharmacist and a graduate of a school recognized as\nin good standing by the Kentucky Board of Pharmacy.\n(3) The cabinet may carry out the provisions of KRS 217.005 to 217.215 and\nregulations relating to food processing establishments, food storage warehouses,\nsalvage distributors, or salvage processing plants or r etail food establishments\nthrough local health departments.","path":["KRS Chapter 217"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=9302","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:25Z","sha256":"cd8e0573631bfa405d67bd5c057bfdfec878ab40e22622713d1f97cc371fe6d8","source_id":"us-ky","stale":false,"prev":"us-ky/krs-217.150","next":"us-ky/krs-217.160"},"notice":"GroundRules: Original legal text.
