{"data":{"id":"us-ky/krs-217.175","jurisdiction":"us-ky","citation":"KRS 217.175","heading":"Prohibited acts.","body":"The following acts and the causing thereof within the Commonwealth of Kentucky are\nhereby prohibited:\n(1) The manufacture, sale, or delivery, holding or offering for sale of any food, drug,\ndevice, or cosmetic that is adulterated or misbranded;\n(2) The adulteration or misbranding of any food, drug, device, or cosmetic;\n(3) The receipt in commerce of any food, drug, device, or cosmetic that is adulterated\nor misbranded, and the delivery or proffered delivery thereof for pay or otherwise;\n(4) The sale, delive ry for sale, holding for sale, or offering for sale of any article in\nviolation of KRS 217.075;\n(5) The dissemination of any false advertisement;\n(6) The refusal to permit entry or inspection, or to permit the taking of a sample or to\npermit access to records or evidence, as authorized by KRS 217.155;\n(7) The giving of a guaranty or undertaking which guaranty or undertaking is false,\nexcept by a person who relied on a guaranty or undertaking to the same effect\nsigned by, and containing the name and address of the person residing in the\nCommonwealth of Kentucky from whom he received in good faith the food, drug,\ndevice, or cosmetic;\n(8) The removal or disposal of a detained or quarantined article in violation of KRS\n217.115;\n(9) The alteration, mutilation, de struction, obliteration, or removal of the whole or any\npart of the labeling of, or the doing of any other act with respect to a food, drug,\ndevice, or cosmetic, if such act is done while such article is held for sale and results\nin such article being adulterated or misbranded;\n(10) Forging, counterfeiting, simulating, or falsely representing, or without proper\nauthority using any mark, stamp, tag, label, or other identification device authorized\nor required by regulations promulgated under the provisions o f KRS 217.005 to\n217.215;\n(11) The using, on the labeling of any drug or in any advertisement relating to such drug,\nof any representation or suggestion that any application with respect to such drug is\neffective under KRS 217.075, or that such drug compli es with the provisions of\nsuch section;\n(12) The manufacture, sale or exchange of any filled milk;\n(13) The manufacture, mixing, compounding, selling, or offering for sale of any flour\nunless the same is enriched; provided that this prohibition shall not a pply to flour\nsold to bakeries or other commercial secondary processors, which flour is used only\nin the production of enriched flour or enriched bread or in the manufacture of\nproducts not required to be enriched;\n(14) The manufacture, baking, sale, or offering for sale of any bread except bread\nconforming to the definition of enriched bread.","path":["KRS Chapter 217"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=9306","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:25Z","sha256":"0d270a93b5d6b6e4f078430423b2a26ac0ff4b1954ef5e8b6184576fe9d22d96","source_id":"us-ky","stale":false,"prev":"us-ky/krs-217.170","next":"us-ky/krs-217.177"},"notice":"GroundRules: Original legal text.
