{"data":{"id":"us-ky/krs-217.182","jurisdiction":"us-ky","citation":"KRS 217.182","heading":"Sale, distribution, administration, prescription, or possession of legend","body":"drugs -- Penalty.\n(1) A duly licensed manufacturer, distributor, or wholesaler may sell or distribute a\nlegend drug to any of the following:\n(a) A manufacturer, wholesaler, or distributor;\n(b) A pharmacy;\n(c) A practitioner;\n(d) The administrator in charge of a hospital, but only for use by or in that\nhospital; and\n(e) A person in charge of a laboratory, but only for use in that laboratory for\nscientific and medical research purposes.\n(2) A pharmacist may sell or distribute a legend drug:\n(a) Pursuant to a prescription that conforms to the requirements of this chapter; or\n(b) To a person licensed to administer, dispense, distribute, or possess a legend\ndrug.\n(3) A practitioner may:\n(a) Administer, dispense, or prescribe a legend drug for a legitimate medical\npurpose and in the course of professional practice; or\n(b) Distribute a legend drug to a person licensed to administer, dispense,\ndistribute, or possess a legend drug.\n(4) Possession or control of legend drugs obtained as authorized by this section shall be\nlawful if it occurred in the regular course of business, occupation, profession,\nemployment, or duty of the possessor.\n(5) No person shall traffic in any legend drug except as authorized by this section.\n(6) No person shall dispense, prescribe, distribute, or administer any legend drug except\nas authorized by this section.\n(7) No person shall possess any legend drug except as authorized by this section.\n(8) Unless another specific penalty is provided in KRS 217.005 to 217.215, any person\nwho violates any provision of subsections (1) to (6) of this section shall be guilty of\na Class A misdemeanor for the first offense and a Class D felony for subsequent\noffenses.\n(9) Unless another specific penalty is provided in KRS 217.005 to 217.215, any person\nwho violates the provision of subsection (7) of this section shall be guilty of a Class\nB misdemeanor.\n(10) A person to whom or for whose use a legend drug has been p rescribed or dispensed\nmay lawfully possess it.","path":["KRS Chapter 217"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=9310","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:25Z","sha256":"4a588cdbae460c74cde24ef33299736a1c1301cbcc2cda505945d5a0a8dd3117","source_id":"us-ky","stale":false,"prev":"us-ky/krs-217.181","next":"us-ky/krs-217.184"},"notice":"GroundRules: Original legal text.
