{"data":{"id":"us-ky/krs-217.207","jurisdiction":"us-ky","citation":"KRS 217.207","heading":"Theft, criminal possession, trafficking, or unlawful possession of a","body":"prescription blank.\n(1) A person is guilty of theft of a prescription blank when he unlawfully takes or\nexercises control over a prescription blank belonging to another.\n(2) A person  is guilty of criminal possession of a prescription blank when, with\nknowledge that he has no lawful authority to possess a prescription blank, he\npossesses a prescription blank with the intent to make or utter a forged prescription\nor sell or transfer the prescription blank to another person for that purpose.\n(3) A person is guilty of trafficking in prescription blanks when he knowingly and\nunlawfully traffics in a prescription blank or a forged prescription for a legend drug.\n(4) The knowing, with intent to violate this chapter, possession of a prescription blank\nby a person other than a pharmacist, practitioner, or other person authorized by law\nto prescribe or dispense a legend drug, a manufacturer, wholesaler, or distributor, or\nby a person lawfully pri nting or reproducing prescription blanks, shall be prima\nfacie evidence that the prescription blank was possessed for the purpose of making\nor uttering a forged prescription or for sale or transfer to another person for that\npurpose.\n(5) Any person who violates any subsection of this section shall be guilty of a Class A\nmisdemeanor for the first offense and a Class D felony for a second or subsequent\noffense.","path":["KRS Chapter 217"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=9318","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:25Z","sha256":"b6ac0a4af4ab485686e63779efa8c39d924beb870c6cfea83e890828ad426796","source_id":"us-ky","stale":false,"prev":"us-ky/krs-217.205","next":"us-ky/krs-217.208"},"notice":"GroundRules: Original legal text.
