{"data":{"id":"us-ky/krs-217.211","jurisdiction":"us-ky","citation":"KRS 217.211","heading":"Electronic prescribing.","body":"(1) Electronic prescribing of a drug or device under this chapter shall not interfere with\na patient's freedom to select a pharmacy.\n(2) Electronic prescribing software used by a practitioner to prescribe a drug or device\nunder this chapter may include clinical messaging and messages in pop-up windows\ndirected to the practitioner regarding a particular drug or device that supports the\npractitioner's clinical decision making.\n(3) Drug information contained in electronic prescribing software to prescribe a drug or\ndevice under this chapter shall be consistent with Food and Drug Administration -\napproved information regarding a particular drug or device.\n(4) (a) Electronic prescribing software used by a practitioner to prescribe a drug or\ndevice under this chapter ma y show information regarding a payor's\nformulary, copayments, or benefit plan, provided that nothing in the software\nis designed to preclude a practitioner from selecting any particular pharmacy\nor drug or device.\n(b) If electronic prescribing software doe s show information regarding a payor's\nformulary, payments, or benefit plan under paragraph (a) of this subsection,\nthe information shall be updated at least quarterly to ensure its accuracy.\n(5) Each governmental unit of the Commonwealth promulgating admi nistrative\nregulations relating to electronic prescribing shall include in the regulations\nelectronic prior authorization standards meeting the requirements of KRS 304.17A -\n167 in its implementation of health information technology improvements as\nrequired by the Medicare Prescription Drug, Improvement, and Modernization Act\nof 2003 and the Health Information Technology for Economic and Clinical Health\nAct, enacted as part of the American Recovery and Reinvestment Act of 2009.","path":["KRS Chapter 217"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=49554","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:52:25Z","sha256":"b94bd296022396df2862a9db58f92188842e29f8222c72716445c91b949fe18f","source_id":"us-ky","stale":false,"prev":"us-ky/krs-217.210","next":"us-ky/krs-217.214"},"notice":"GroundRules: Original legal text.
